Neo-Liberalism and the Retreat of Democracy

Democracy across the world is under siege. This according to the latest Freedom House report documenting that for 2017, “democracy faced its most serous crisis in decades” as seventy-one countries experienced declines in freedom or fair government, including the United States, and only thirty-five an improvement. This was the twelfth consecutive year of decline in democracy world-wide.

The question is why? Why has confidence in democracy retreated? Freedom House does not provide an answer, but there is a reason. It is democracy’s marriage to neo-liberal capitalism has fostered the conditions leading to its own undoing, similar to the way Karl Marx once described in the Communist Manifesto the “gravedigger thesis” (What the Bourgeoisie therefore produces, above all, are its own grave diggers”) where capitalism would produce the conditions that would undermine its own existence.

From the 1960s until the early 1990s democracy was in the upswing internationally. African de-colonization produced initially popularly elected governments. In South America the demise of strongmen led to a wave of democratic regimes. And the fall of the Berlin Wall in 1989 and the break up of the USSR in 1991 produced the dismantling of communist authoritarian or totalitarian governments that made it possible for Francis Fukuyama to proclaim that democracy had won and emerged as the last grand global political meta-narrative.

Yet several problems upset this rosy picture. Most prominently, it was the marriage of these new emerging democracies with free market capitalism and the victory of neo-liberalism. Internationally as post-colonial and post-communist countries emerged, international organizations such as the World Bank and the IMF forced them to adopt market reforms, often pushing them into what was then called “shock therapy.” Shock therapy involved rapid privatization of state owned enterprises and rapid dismantling of welfare states. This shock therapy was often accompanied by significant corruption as a few rich oligarchs emerged who came to own these newly privatized state enterprises.

Simultaneously, emerging democracies were rapidly pushed into what sociologist Immanuel Wallerstein would call the world-capitalist system. This system turned politically to right in the 1970s and 1980s as Margaret Thatcher in the United Kingdom and Ronald Reagan in the United States pushed neo-liberalism or market fundamentalism as an alternative to the Keynesian welfare state that had dominated the west since the 1930s. It was adopted both for ideological reasons and because of what political economist James O’Connor would call the fiscal crisis of the state tht affect economics across the world in the 1970s. This was a crisis of declining profit among private businesses and therefore declining revenue for states to fund welfare programs. Something had to give, and it was the welfare state.

Neo-liberalism is a political economic theory of the state committed to the laissez-faire market fundamentalism ideology that traces back to Adam Smith and David Ricardo. It includes a belief in comparative advantage, a minimalist state, and market freedom, and is, as articulated in the 1990s and 2000s, driven by finance capital. At the state level, neo-liberalism defines a theory of public administration. If neo-liberalism includes a commitment to market fundamentalism, then that also means that it is dedicated to a politics of limited government. This includes privatization, deregulation, and a scaling back of many traditional functions that capitalist and communist states had performed since at least World War II. But neo-liberalism as a theory transcends the state, providing also an international economic theory committed to free trade and globalism.

This emergence of neo-liberalism in the 1970s and its linkage to democracy is central to the crisis affecting the latter. As neo-liberalism retrenched the welfare state and pushed globalism it was accompanied by a dramatic increase in economic inequality in the world, as Thomas Piketty has pointed out. This occurred in the US and much of the western world. But it also impacted newly emerging democracies in Africa, Eastern Europe, and South America. Pressures for shock therapy market reforms, austerity, and open borders meant export of jobs to other countries, dismantling of social safety nets, and other economic pressures placed on governments and ruling parties.

Politically voters turned on globalism and free trade. This happened here with Trump voters in 2016, but also in Brexit in the UK. But many voters also blamed immigrants for the loss of jobs or social unrest in places ranging from France, to Italy, to Hungary. The increasing economic gap between rich and poor and, more importantly, the erosion of the economic conditions of the working class soured them on democracy. This paved the way for the emergence of strongmen as political leaders, the rise of far-right nationalist parties, and disenchantment with democracy and democratic structures to deliver the economic goods.

What we see today then in terms of the decline in support for democracy across the world is a product of its marriage to neo-liberalism. Capitalism and democracy always had an uneasy co-existence, but the neo-liberal democracy variant demonstrates the powerful contradictions in them. Either their linkage is producing outright rejection of democracy or a populist, rightist version that is merely democracy in form but not in substance.

The Art of War: The Western American Empire in Crisis

The US tariff war against China and the new sanctions against Russia are signs of a trend that goes beyond current events.

To understand what it is, we should go back about thirty years ago. In 1991 the United States, winners of the Cold War and of the first war after the Cold War, waged in the Gulf, declared that “the United States remains the only state with truly global strength, reach and influence in every dimension – political, economic and military” and that “there is no substitute for American leadership ” in the world.

By relying on the dollar hegemony, on the global reach of its multinationals and its financial groups, on the control of international organizations (IMF, World Bank, WTO), the United States promotes “free trade” and “Free movement of capital” on a global scale, reducing or eliminating tariffs and rules. The other Western powers move in their wake.

The Russian Federation, in a profound crisis after the disintegration of the USSR, is considered by Washington as an easy land of conquest, to be dismembered to better control its great resources. China, open to the market economy, also appears to be conquerable with US capital and products and exploitable as a large reservoir of low-cost labor.

Thirty years later, the “American dream” of the unchallenged domination of the world has vanished.

Russia, by putting up an internal front to defend national sovereignty, has overcome the crisis and regained the status of great power.

China, “the world’s factory” where also US multinationals produce, has become the world’s leading exporter of goods and makes increasing foreign investments. Today it challenges the technological supremacy of the United States.

The project of a new Silk Road – a road, rail and maritime network between China and Europe through 60 countries – places China at the forefront of the process of globalization, while the United States is perched erecting economic barriers.

Washington looks with growing concern at the economic and political partnership between Russia and China, which challenges the hegemony of the dollar.

Failing to oppose this process only through economic instruments, the United States resorts to the military ones. The putsch in Ukraine and the subsequent nuclear escalation in Europe, the strategic shift to Asia, the wars in Afghanistan and Syria, are part of the strategy with which the US and the other Western powers try to maintain the unipolar dominance in a world that is becoming multipolar.

However, this strategy is suffering a series of setbacks. Russia and China, under increasing military pressure, reacted by strengthening their strategic cooperation.

Russia has not been got on the ropes but, in a surprise move, intervened militarily in support of the Syrian State which, in the US / NATO plans, should have ended up like the Libyan State. In Afghanistan, US and NATO are mired in a war that has been going on for over 17 years.

As a reaction to these failures, the propaganda campaign is intensified to make Russia appear as a dangerous enemy, also using the false flag of chemical attacks in England and Syria.

The same technique was used in 2003 when, to justify the war against Iraq, Secretary of State Colin Powell presented to the UN the “evidence” that Iraq possessed weapons of mass destruction. Powell, in 2016, had to admit the non-existence of such weapons. In 15 years, however, the war has caused over a million deaths.

The Globalisation of Bad Food and Poor Health: Sustainable Development or Sustainable Profits?

The proportion of deaths due to cancer around the world increased from 12 percent in 1990 to 15 percent in 2013. Globally, cancer is already the second-leading cause of death after cardiovascular diseases.

In India, government data indicates that cancer showed a 5 percent increase in prevalence between 2012 and 2014 with the number of new cases doubling between 1990 and 2013. The incidence of cancer for some major organs in India is the highest in the world. Reports have also drawn attention to rising rates of breast cancer in urban areas, and, in 2009, there was a reported increase in cancer rates in Tamil Nadu’s textile belt, possibly due to chemically contaminated water.

The increase in prevalence of diabetes is also worrying. By 2030, the number of diabetes patients in India is likely to rise to 101 million (World Health Organisation estimate). The number doubled to 63 million in 2013 from 32 million in 2000. Almost 8.2 percent of the adult male population in India has diabetes. The figure is 6.8 percent for women.

In India, almost 76,000 men and 52,000 women in the 30-69 age group died due to diabetes in 2015, according to the WHO. The organisation reports South-East Asia had a diabetic population of around 47 million, which is expected to reach 119 million by 2030.

A new study in The Lancet has found that India and China continue to have the largest number of underweight people in the world; however, both countries have broken into the top five in terms of obesity.

India leads the world in terms of underweight people. Some 102 million men and 101 million women are underweight, which makes the country home to over 40 percent of the global underweight population.

Contrast this with India’s surge in obesity. In 1975, the country had 0.4 million obese men or 1.3 percent of the global obese men’s population. In 2014, it was in fifth position globally with 9.8 million obese men or 3.7 percent of the global obese men’s population. Among women, India is globally ranked third, with 20 million obese women or 5.3 percent of global population.

Although almost half the nation’s under-5s are underweight, the prevalence of underweight children in India is among the highest in the world; at the same time, the country is fast becoming the diabetes and heart disease capital of the world.

Many social and economic factors, including environmental pollution, poor working and living conditions, tobacco smoking, lack of income and economic distress, lack of access to healthcare and poverty, contribute to ill health and disease. However, conditions like cardiovascular disease and obesity have among other things been linked to sedentary lifestyles and/or certain types of diet, not least modern Western-style convenience food (discussed later).

Western junk food aside, it will be shown that even when we have access to sufficient calorific intake or seemingly nutritious and wholesome traditional diets, there is little doubt that due to the processes involved in growing and processing the food we eat, diet can be a (major) contributory factor in causing certain conditions and illnesses.

The junk food revolution, ‘free’ trade and poor health

The impact of the North American Free Trade Agreement on Mexico and the subsequent flood of cheap US processed food into the country has adversely affected the health of ordinary people. Western ‘convenience’ (junk) food has displaced more traditional-based diets and is now readily available in every neighbourhood. Increasing rates of diabetes, obesity and other health issues have followed. This report by GRAIN describes how US agribusiness and retailers have captured the market south of the border and outlines the subsequent impact on the health of Mexican people.

In Europe, due to the ‘harmonisation’ of food regulatory standards, the Transatlantic Trade and Investment Partnership (TTIP) could seriously impact the health of Europeans. Washington wants Europe to eliminate all restrictions on imports of food from the US and to adopt a US-style food supply regulatory regime, stripped of the precautionary principle. US corporations want to make it difficult for European consumers to identify whether what they’re eating is food that was produced using health-damaging practices that EU consumers are against, like GMOs, chlorine-washed chicken and meat from animals treated with growth hormone.

These types of trade agreements represent little more than economic plunder by transnational corporations. They use their massive political clout to author the texts of these agreements with the aim of eradicating all restrictions and regulations that would impede greater profits.

Western agribusiness, food processing companies and retail concerns are gaining wider entry into India and through various strategic trade deals are looking to gain a more significant footprint within the country. The Knowledge Initiative on Agriculture and the ongoing India-EU free trade agreement (like TTIP, both are secretive and largely authored by powerful corporations above the heads of ordinary people) talks have raised serious concerns about the stranglehold that transnational corporations could have on the agriculture and food sectors, including the subsequent impact on the livelihoods of hundreds of millions and not least the health of the public.

Western style fast-food outlets have already been soaring in number throughout the country. Pizza Hut now operates in 46 Indian cities with 181 restaurants and 132 home delivery locations, a 67 percent increase in the last five years). KFC is now in 73 cities with 296 restaurants, a 770 percent increase. McDonalds is in 61 Indian cities with 242 restaurants as compared to 126 restaurants five years back, a 92 percent increase). According to a study published in the Indian Journal of Applied Research, the Indian fast food market is growing at the rate of 30-35 percent per annum (see this).

Heart disease, liver damage, stroke, obesity and diabetes are just some of the diseases linked to diets revolving around fast-food. Frequent consumption of fast food has been associated with increased body mass index as well as higher intakes of fat, sodium, added sugars and sugar-sweetened beverages and lower intakes of fruits, vegetables, fibre and milk in children, adolescents and adults. Fast food also tends to have higher energy densities and poorer nutritional quality than foods prepared at home and in comparison with dietary recommendations (see this).

To further appreciate just how unhealthy even seemingly healthy food can be in well-stocked supermarkets, this report in The Guardian reveals the cocktails of additives, colourants and preservatives that the modern food industry adds to our food.

Moreover, in many regions across the globe industrialised factory farming has replaced traditional livestock agriculture. Animals are thrown together in cramped conditions to scale up production and maximise output at minimum cost. For example, just 40 years ago the Philippines’ entire population was fed on native eggs and chickens produced by family farmers. Now, most of those farmers are out of business. And because world trade rules encourage nations from imposing tariffs on subsidised imported products, they are forced to allow cheap, factory-farmed US meat into the country. These products are then sold at lower prices than domestic meat. There is therefore pressure for local producers to scale up and industrialise to compete.

Factory farms increase the risk of pathogens like E coli and salmonella that cause food-borne illness in people. Overuse of antibiotics can fuel the growth of antibiotic-resistant bacteria, the use of arsenic and growth hormones can increase the risk of cancer in people and crowded conditions can be a breeding ground for disease. And genetically modified animal feed is also a serious issue, leading to concerns about the impact on both animal and human health.

The green revolution, micronutrient deficient soil and human health

We often hear unsubstantiated claims about the green revolution having saved hundreds of millions of lives, but any short-term gains have been offset. This high-input petro-chemical paradigm helped the drive towards greater monocropping and has resulted in less diverse diets and less nutritious foods. Its long-term impact has led to soil degradation and mineral imbalances, which in turn have adversely affected human health (see this report on India by botanist Stuart Newton – p 9 onward).

Adding weight to this argument, the authors of this paper from the International Journal of Environmental and Rural Development state:

“Cropping systems promoted by the green revolution have increased the food production but also resulted in reduced food-crop diversity and decreased availability of micronutrients (Welch, 2002; Stein et al., 2007). Micronutrient malnutrition is causing increased rates of chronic diseases (cancer, heart diseases, stroke, diabetes and osteoporosis) in many developing nations; more than 3 billion people are directly affected by the micronutrient deficiencies (Cakmak et al., 1999; Welch, 2002; WHO, 2002; Welch and Graham, 2004). Unbalanced use of mineral fertilizers and a decrease in the use of organic manure are the main causes of the nutrient deficiency in the regions where the cropping intensity is high (Prasad, 1984; Welch, 1993, 2005).”

The authors imply that the link between micronutrient deficiency in soil and human nutrition is now regarded as crucial:

“Moreover, agricultural intensification requires an increased nutrient flow towards and greater uptake of nutrients by crops. Until now, micronutrient deficiency has mostly been addressed as a soil and, to a smaller extent, plant problem. Currently, it is being addressed as a human nutrition problem as well. Increasingly, soils and food systems are affected by micronutrients disorders, leading to reduced crop production and malnutrition and diseases in humans and plants (Welch et al., 1982; Welch and Graham, 2004). Conventionally, agriculture is taken as a food-production discipline and was considered a source of human nutrition; hence, in recent years many efforts (Rengel and Graham, 1995a, b; Cakmak et al., 1999; Frossard et al., 2000; Welch and Graham, 2005; Stein et al., 2007) have been made to improve the quality of food for the growing world population, particularly in the developing nations.”

Pesticides, the environment, food and health

Hand in hand with the practices outlined above has been the growth of the intensive use of chemical pesticides. There are currently 34,000 pesticides registered for use in the US. Drinking water is often contaminated by pesticides and more babies are being born with preventable birth defects due to pesticide exposure. Illnesses are on the rise too, including asthma, autism and learning disabilities, birth defects and reproductive dysfunction, diabetes, Parkinson’s and Alzheimer’s diseases and several types of cancer. The association with pesticide exposure is becoming stronger with each new study.

In Punjab, pesticide run-offs into water sources have turned the state into a ‘cancer epicentre‘, and Indian soils are being depleted as a result of the application of green revolution ideology and chemical inputs. India is losing 5,334 million tonnes of soil every year due to soil erosion because of the indiscreet and excessive use of fertilisers, insecticides and pesticides. The Indian Council of Agricultural Research reports that soil is become deficient in nutrients and fertility.

India is one of the world’s largest users of pesticides and a profitable market for the corporations that manufacture them. Ladyfinger, cabbage, tomato and cauliflower in particular may contain dangerously high levels because farmers tend to harvest them almost immediately after spraying. Fruit and vegetables are sprayed and tampered with to make them more colourful, and harmful fungicides are sprayed on fruit to ripen them in order to rush them off to market.

Consider that if you live in India, the next time you serve up a good old ‘wholesome’ meal of rice and various vegetables, you could be taking in half a milligram of pesticide also. That would be much more than what an average North American person would consume.

Research by the School of Natural Sciences and Engineering (SNSE) at the National Institute of Advanced Studies in Bangalore has indicated disturbing trends in the increased use of pesticide. In 2008, it reported that many crops for export had been rejected internationally due to high pesticide residues. Moreover, India is one of the largest users of World Health Organization (WHO) class 1A pesticides, including phorate, phosphorus, phosphamidon and fenthion that are extremely hazardous.

Kasargod in Kerala is notorious for the indiscriminate spraying of endosulfan. The government-owned Plantation Corporation of Kerala aerially sprayed the harmful pesticide on cashews for a period of over 20 years. Consequently, it got into rivers, streams and drinking water. Families and their children have been living with physical deformities, cancers and disorders of the central nervous system ever since.

Officials and the pesticide companies benefited from the spraying. At the time, cashew was grown without pesticides throughout Kerala, but the government-run plantation invested millions of rupees of public money in spraying the deadly pesticide. Endosulfen poisoning cases also emerged elsewhere, including Karnataka.

The SNSE notes that pesticide use across India has greatly increased over the years. This not only impacts the health of consumers but also the health of agricultural workers who are subject to pesticide drift and spaying, especially as they tend to wear little or no protection. Research by SNSE shows farmers use a cocktail of pesticides and often use three to four times the recommended amounts (see this).

Forced-fed development: who benefits?

If there are any beneficiaries in all of this, it is the pesticide manufacturers, the healthcare sector, especially private clinics and drug companies, and the transnational food and agribusiness companies, which now see their main growth markets in Asia, Africa and South America, where traditionally people have tended to eat food from their own farms or markets that sell locally-produced foods.

Of course, the commodification and privatisation of seeds by corporate entities, the manufacturing and selling of more and more chemicals to spray on them, the opening up fast food outlets and the selling of pharmaceuticals or the expansion of private hospitals to address the health impacts of the modern junk food system (in India, the healthcare sector is projected to grow by 16 percent a year) all amounts to the holy grail of neoliberal capitalism, GDP growth; which increasingly means a system defined by jobless growth, greater personal and public debt and massive profits for large corporations and banks.

While there are calls for taxes on unhealthy food and emphasis is placed on encouraging individual ‘lifestyle changes’ and ‘healthy eating’, it would be better to call to account the corporations which profit from the growing and production of health-damaging food in the first place and to get agriculture off the chemical treadmill.

Part of the solution entails restoring degraded soils. It also includes moving towards healthier and more nutritious organic agriculture, encouraging localised rural and urban food economies that are shielded from the effects of rigged trade and international markets and shying away from the need for unhealthy food-processing practices, unnatural preservatives and harmful additives.

In India, it also involves calling a halt to the programmed dismantling of local rural economies and indigenous agriculture under the guise of ‘globalisation’ for the benefit of transnational agribusiness and food retail corporations. And it entails placing less emphasis on a headlong rush towards urbanisation (and the subsequent distortion of agricultural production), while putting greater emphasis on localisation.

Setting the Stage of the Press-President War

US ruling ideology and Washington power have become unstuck as never before. A war of opposing certitudes and denunciations is waged day to day between the long-ruling US corporate media and the White House. Both continuously proclaim ringing recriminations of the other’s ‘fake news’. Over months they both portray each other as malevolent liars.

US bully pulpits are now beyond show disagreements and successful media inquisitions of the past. Slanderous accusations long confined to vilifying the designated Enemy have crept into accusations of the President himself. ‘The Russians are coming’ is returning as the final recourse of smear to stop deviations from the global program of hugely profitable enemy hate and perpetual preparations for foreign war.

The ruling big lies of the US money party and corporate globalization have divided into opposing camps. The Press and the President denounce each other non-stop on the public stage, while US dark state agents take sides behind the scenes.

Fake news is the medium of battle.

Tracking the Real Fake News Built into Corporate Globalization

Beneath the civil war of official narratives, cognitive space opens for truth long suffocated by ‘the Washington Consensus’. Even the US-led G-20 has recently agreed not to automatically condemn ‘protectionism’ as an economic evil. The battle slogan of transnational corporate rule over 30 years has been quietly withdrawn on the global stage.

Is the big lie of ‘free trade’ finally coming to ground? It has long led the hollowing out of societies and life support systems across the world in a false mass promotion as “freedom and prosperity for all”. In fact beneath the pervasive fake news, a closed-door transnational corporate command system forces all enterprises across borders into a carbon-multiplying trade regime with thousands of rules to protect the transnational corporate looting and ruin of home economies and environments as the only rights enforced.

Propagandist names and fake freedoms are proclaimed everywhere to conceal the reality. The corporate-investor regime has stripped out almost all evolved protections of workers, ecologies and social infrastructures. Non-stop liquidations and roboticizations of local jobs and enterprises are reversed in meaning to ‘jobs, jobs, jobs’ and ‘higher living standards’, the very opposite of the facts. Destabilization and bombing wars attack resource-rich and air-defenceless societies outside the circle of treaty subjugation.

False news allows every step. Even the happy-face Trudeau regime is taken aback by the tidal shift to national priorities. Its ministers scuttle around the US in near panic to find common cause for restoring the unaccountable regime. Multiplying carbon, disemployment and ecological plunder are ignored throughout in the longest standing fake news of all –‘economic growth”.

In fact, there is no real economic growth in universal life necessities or reduction of waste. The only growth is of volumes and velocities of transnational money exchanges, foreign commodities, and private profits to the top.

‘More prosperity for nations and the world’ means, decoded, more transnational corporate-state treaties to deprive nations of their rights to organization and production for citizens’ real needs as well as organically regulated protection of environments and ecosystems.

The consequences covered over by pervasively false cover stories are speeded-up ecocidal extractions, permanent disemployments, and wastes hemorrhaging into cumulatively more polluted oceans, air, atmosphere and life habitats. Corporate-state solutions of carbon markets for pollution rights have nowhere reduced any of these life-and-death crises, but only further and selectively enriched transnational corporations.

As for the Obama solution, “we need more Canadas”, fake news again conceals the reality. Beneath the global celebrity hype covering empty and broken promises, Canada’s Trudeau regime is essentially a brand change of PM rhetoric to advance transnational corporate dictates as ‘free trade’ and to ensure oil pipelines out of the most polluting oil basin in the world, Alberta’s tar-sands, are built through water basins and indigenous lands across Canada and the US. One cannot help but observe this is Trump’s plan too, and overrides Trudeau’s promises to protect Canada’s first peoples.

I recently sent a letter to my local MP requesting evidence for what PM Trudeau promises over months of repetition that “more free trade” means “a better life for those in the middle class and those wanting to join the middle class”. As always, there is no evidence to support the non-stop false news from the PMO. Revealingly, the “middle class” turns out to be people making $180,000 a year slated to get significant tax cuts.

Trump’s rogue elephant charge on Washington-led lies, war, and dispossession of the working class is no solution to life-blind corporate globalization. Trump in office is a US nationalist oligarch commanding policies even more blindly rapacious in despoliation of the environment and transferring far more public wealth to the rich.

The common ground of all our lives, collective life capital, does not exist for any government in ‘the free world’ or any policy of ‘globalization’. The lies that must be promulgated to advance the private corporate agenda are built into its transnational command system from the beginning.

Out of the Ruling Memory Hole with the Internet Commons

Joining the dots shows that every step of US money-party ‘globalization’ has, in fact, been driven by fake news.

No corporate media tolerance has been given in a quarter of a century to any voice demanding accountability to the common life-ground of citizens. A new game of numbers has proceeded instead. At most, a euphemistic ‘climate change’ has been endlessly debated while the totalizing destabilization of human and planetary life cycles remains without a name or collective response. Only more profitable market panaceas which do not reduce any pollution continue to divert from the deepest degenerate trends destroying the planetary life host.

On the upside, the big lies of ‘free trade’ and ‘humanitarian wars’ have been called into official question for the first time by the Trump presidential campaign, and he has been elected against the official line. Yet opposing camps are still at each other’s throats. So the perpetual fallback on accusing the long-designated foreign enemy is triggered by the fallen establishment. The fake news chorus of Russia’s aggressions now includes collusion of the Trump administration with its officials to win the US election. This mainspring diversion from reality is called back from the dead witch-hunts of the past. As then tool, facts do not count, only accusations do. The official media line is almost predictable: Russia is behind Trump’s election victory. As always, reverse projection is the mass-psyche operation to blame an official Enemy to divert attention from the life-and-death facts. The Enemy is once again accused of doing what the US has always done worse as the reason for attacking It. Russia is the usual placeholder in this reverse-blame operation. The 2016 US election of Trump is the latest variation.

Meanwhile throughout the election and its aftermath, the new transnational internet commons including Wiki-leaks over a decade has increasingly laid bare the greatest propaganda machine in history now in many-leveled crisis. The long normalized half-truths, one-sided slanting of the facts, and non-stop fallacies of inference are coming out into the open as never before. The pretexts and lies for US imperial bullying and war are exposed beyond any corporate-media gate.

This time the accusation is “interference and attack on the US presidential election” with no evidence of wrongdoing or vote manipulation whatsoever. Yet as in the long past, the method is smear with no evidence for the accusations. Ever more media repetition and shadowy insinuation does the job. It has always worked before, why not again since all the other media buttons pushed on taking down the Trump peace initiatives with Russia and opposition to globalization of US jobs have failed.

Having wondered during the election campaign whether we could be “friends with Russia” and promoted diplomatic relations into his administration, Trump can be named as the enemy in hiding to be rooted out. The real problem the fake news never mentions is that he threatens the cornerstone of the US war state over 70 years.

So when Trump won the election with his heresy still intact, the ever-ready accusation of evil-Russia connection moves into high gear although the target is the opposite of communist and an epitome of capitalist riches and connections. We see here the historical mind-lock compulsion to blame the Enemy Russia and smear whoever dissents from it, even if it is a bully-capitalist president. There are very big stakes in keeping the game going.

Yet the no-profit and unpaid analyses from the internet commons have no such ulterior motive and interest in false accusations. With more objectively informed analysts than the commercial press and unimpeachable facts like WikiLeaks going to tens of millions of readers across the world, the genie is out of the bottle. The official grand narrative and its normalized big lies are coming apart at the seams.

So blame as usual is diverted onto the accepted Enemy, now conniving with Trump to attack the 2016 US presidential election. Beneath the fake news, the fact is that positive diplomatic relations with Russia not only threaten to stop the highly profitable permanent war against it, but spike the longest pretext for US war and military domination now moving through Ukraine.

The free internet commons cannot be gagged for telling the truth. Freedom of speech in the US cannot be openly stopped without fatal loss of legitimacy of rule.

So the rest follows. All the non-corporate and non-profit messages from the critical sites on the internet commons which are speaking against the US war state inside are now vilified as ‘fake news’. A third, unofficial protagonist has entered the battle with no private profit or career motive or corporate boss to serve and a wealth of proven professional knowledge and talent at work. It has to be denounced to sustain the big lies of the ruling money-war game which is in deepening crises and conflicts all the way to the unprecedented US President-Press civil war.

The Harvard Proclamation of a New Memory Hole

The innermost fount of US ideology and war, Harvard University, has now stepped in. It is officially naming and denouncing US-critical internet sites for ‘fake news’.

Not even the medieval Church went so far in its Index Librorum Prohibitorum of prohibited writings. It was at least innocent of scientific method and openly declared its dogmas. Not Harvard.

Underneath notice, all the sites it attacks are internet commons, and none are financed by private corporate donors and captive institutions while Harvard and the corporate media are. This is the real battle agenda underneath, the long war to privatize the news for profit as everything else with anti-establishment internet criticism now the target.

In the background, Harvard University has long propagated an unexamined academic method. It normally cuts off any faculty or learned source of opposition to the private corporate rule of America and the wars of aggression to impose it on the world. Accordingly, the underling grand narrative equations of the US is Good and the designated Enemy is Evil is not questioned. It is presupposed. Malevolent motives are always assumed of the designated Enemy, down to Harvard-produced geostrategic economic and war models. So when a host of internet commons sites challenge the grand narrative framework, Harvard and satellites denounce them to stop people reading them. A long list of critical sites is accused without criteria, proof or evidence as all spreaders of ‘fake news’.

What is not recognised here is that only on the internet commons can the process of truth be free from ruling pressures to control message for external sponsors.

Here there is no commercial-profit condition to speak and write, and no livelihood dependence on private profit. There is no inducement to avoid life-and-death issues in academic obfuscation or ad-vehicle style. Internet authors not on the payroll can be free of the game of all games behind the scenes – enriching the rich further with no life-coherent criterion of truth.

These underlying conditions of the internet commons and free speech itself cannot be recognised by the academy or the corporate press without undercutting their proclaimed status as the only legitimate founts of truth. The internet commons is a new world of competitive capacities to research, understand and disseminate not bound by private money patronage (as over centuries in Harvard University).

When challenged in this way, Harvard (and the official press) are set back on their heels. They cannot think the facts through because their instituted presumptions have long been what they must presuppose and not question to acquire their credentials and pay for public speech. They must attack what calls all this into question if it effectively speaks truth to power to expose or de-legitimate the ruling system narrative as false. Harvard and the US press thus follow the reigning method of reverse projection. They accuse the effective opposition of ‘fake news’.

The most revealing fact here is that Harvard authority as other academic administrations proceed in name-calling without any valid argument or demonstration – the very basis of reasonable conclusion. Yet this is such a long tradition of presumptive accusation allowed against anyone designated as the Enemy, and anyone else exposing the falsehood of the ruling US story of moral superiority over all others and God’s blessing to lead the world by force or money.

This is why only dissenting sites from the official storyline of US freedom and rightness in all things are accused as ‘fake news’. Accusation of opposing positions is so well-worn into conditioned brains that endless repetition locks it in as self-evident. This is why attributions of vile motive are automatic from Harvard or the New York Times for any outside leader opposing US interference in their countries including elections. US hypocrisy here is staggering, but unreported. In fact, Harvard’s life-blind elite of war criminal geo-strategists, economic modellers and so on are fawned upon within the wider corporate rule they serve.

None can engage critical facts and thought challenging the US moral superiority assumptions because they have never been required to consider them. So they denounce them as once the Church denounced apostasy. In the end, US system worship is a war-state religion. It eliminates all enemies to its right to rule. Its globalizing system institutes the market laws of God. War crimes are God-blessed justice.

Freedom of Speech, the Process of Truth, and the US Constitution

Led by senior academics, journalists and technical expertise, the internet commons provide for the first time impartial witness and free speech open to public examination and circulation across borders. They are free from corporate-rank dictate and private copy-right control.

In consequence, the internet commons are liberated from private corporate profit as controlling goal. Those who know what they are talking about can speak truth to dogma and power without words to appease editors, business boards and ad revenues. Truth itself is not defined, but its principle of process is a more inclusively consistent taking into account towards life-coherent conclusion

Despite Google black-holing of radical legal facts, CIA penetration of Wikipedia, and so on, the internet commons’ freedom of speech is far beyond anything guaranteed in the US constitution. In fact, the ‘sacred US Constitution’ that all presidents give oath to “preserve, protect and defend” guarantees in the end only freedom of public speech to private money demand.

Long before the Supreme Court’s 2010 decision reverse-titled as “Citizens United”, the US constitution was structured to one overriding end – to remove prior limits to private-money right over all else, including to begin, the rule of British law and the lands of the first nations West of the Appalachians.

This is why no common life interest exists in the US Constitution from the start. People’s universal human life necessities of water, food, protection and liveable environment are ruled out a-priori. This is why civil rights themselves were first federally enforced by the ‘commerce clause’ protecting freedom of commercial bus passengers including blacks to cross borders.

It is also why the Fourteenth Amendment to protect the equal rights of freed slaves ended up being the legal basis for private-profit corporations and wealthy funds to acquire the constitutional rights of living persons (e.g., to freedom of speech for big money to buy elections and to avoid government access to financial records).

Even the iconic rights of “life, liberty and happiness” turn out to be in fact only private market rights which allow corporate ‘fictive persons’ to unlimited money wealth, protection against public redistribution, and the freedom of private wealth alone to speak to America by buying corporate self promotions and election attack ads.

The US Constitution fix goes all the way back to 1787. As professor of constitutional law at Chicago’s iconic Kent College of Law, Matthew Stanton, explains in personal correspondence:

“[The fix] goes all the way back to the 1787 coup where the 39 signatories to the Constitution sequestered themselves in a Philadelphia meeting house, with locked doors and shuttered windows, to ostensibly make adjustments to the Articles of Confederation, but instead delivered an entirely new document that enabled creating a federal system centralizing control of the economy by propertied wealth”.

Russia the Enemy: the Deus ex Machina of Fake News

We may recall that the corporate-press and Wall-Street-enriched candidate for the presidency, Hillary Clinton, started the accusation of ‘fake news’ to explain her defeat. As establishment mask of the politically correct masses with the money-war party as her paymaster, Clinton blamed her fall in the 2016 US election on the new enemy she saw arising against the official story and herself. When the ‘glass mirror’ story line did not take, she joined forces with the corporate media on another plane. ‘Fake news’ misled Americans. The New York Times, the Washington Post, the TV Networks, and other establishment tale tellers saw pay-dirt far beyond Clinton’s failed bid for president.

In fact, the corporate mass media were losing marketability by the escalating appeal of free social media. The once all-powerful press propaganda system has been increasingly deserted. The ‘fake news’ story provided a media base to condemn free internet news and commentary as immoral. The 2016 election became the leverage for a big market grab back.

Very soon it was not just ‘fake news’ to spike news cycles and subscriptions. War as peace and corporate globalization as freedom found its long place of rule – the enemy of Russia to blame. Now the news can be that Russia hacked and attacked the lost 2016 election. Russia may be a hollowed-out shell by global corporate and oligarch dispossession. But it can still continue as pretext for US-NATO war crimes and aggression reverse-blamed on it. As the European breadbasket and newly discovered fossil-fuel rich nation, Ukraine is a very big prize. Now in Ukraine’s US-led coup aftermath and ethnic civil war, evil Russia can be an ace card again to accuse for attacking the US election.

Since Russia led by Putin is drawing the line as in Crimea to support the Russia-speaking region against US-led war crimes under international law (documented in previous articles), all roads connect. “Russia’s uncontrolled aggression” is reverse-projected onto the victim again in a glorious new use. Reverse blame it for interference in the US election of Trump and kill Russia-US peace initiatives at the same time. No fact is required to verify the accusation, and no law broken is needed to insinuate treason of whoever relates with Russia’s officials in peace initiative. It can work even against an elected US president.

At the same time, the US’s own record attacking other nations’ elections and societies is thereby erased as well – continually orchestrating mass-murder and dictatorship to sabotage the electoral process from Vietnam and Chile to Ukraine in 2010 and Latin America social democracies since.

If it were a story of reverse projection by a mass-murderous psychopath, it would be too much to believe. Yet it now runs the US news cycle as the big story unfolding with no evidence of US illegality, force, or non-compliance with international law. The accusations run by themselves in US media culture and across the empire. So as 2017 Spring breaks, endless media insinuations of treason seep into the populace from corporate media sites across borders with backrooms and Congress setting up for another presidential inquisition.

It is interesting to observe two precedents. Past inquisitions were unfolded soon after Bill Clinton said in India, “it’s time to level up rather than down in global trade” and Richard Nixon founded the Environmental Protections Agency, stopped corporations from outsourcing US jobs, and made peace with China as Trump sought with Russia.

The ludicrous hypocrisy, factual vacuum, and war-drums of blame-the-enemy go into high-volume operation again, led by an attack-dog media against the elected US president whose only action has been to have business-like relations with Russia. Few observe the immense stakes of the US media and war establishments in this process. Cui bono? – who benefits? – is the question never asked.

What’s new? The perpetual red herring of ‘Russia aggression’ takes everyone’s eyes off the ball – including the continuing US-drone mass murder and ecological wars built into the Trump agenda. Canada’s oil and mining corps and big banks sneak behind the pervasive fake news with a smiling Trudeau front. NATO demands more money behind Trump now fulsomely praising what he earlier campaigned on as “obsolete”, as he has done with the CIA he also condemned. Those hoping for a new departure under Trump from the big lies and war crimes as normalized operations watch in a combination of horror and hilarity.

Who connects the dots? Beneath official notice, the ruling goal of US empire is blind to its consequences of human and planetary life ruin. It has to cover itself in false news to carry on. This is why fake news is not a temporary phenomenon of the Trump era. It is the necessary veil of illusion of an eco-genocidal system. The symptoms and trends are everywhere. But a US-led prism of false inversions of reality regulates consciousness, perception and reaction to ‘steer the course’.

This is true of both sides of the Trump divide, and also in corporate Canada as the US’s largest trading partner, branch-plant and resource cornucopia. What is new is that the ruling illusions are divided against themselves at the top of the US political and ideological system. The Trump phenomenon reflects the rupture. The US empire is in deep crisis from its cumulative destruction of social and natural life support systems. Its carcinomic multiplication of private money demand with no tie to the production of means of life is the reality beneath all the false news.

Nothing is life secure. The ‘global security system’ protects only money values and sequences through life hosts. Peoples everywhere compete to make it go faster to survive. The ruling concept of ‘economy ‘inverts the systematic depletion, degradation and despoliation of the life capital of organic, social and ecological life. Universal necessities of human and fellow life are stripped, polluted and wasted as ‘efficiencies’.

President Trump has gone into the political ring to fight it out with the political establishment on a nationalist capitalist level. He is losing money in the short term. But his program in office is completely eco-blind, and the opposing mass media follow suit. All they can focus on is demonizing normal relations with the official Enemy Russia. Meanwhile Trump has all but abolished the EPA and cut off all federal funding for restoration of the Great Lakes, the most important source of fresh water heritage on the planet.

These supreme crimes under international law are recognised by none on stage. In Canada, a Nazi progeny and neo-Nazi supporter of the violent coup and civil war in Ukraine is made Foreign Affairs Minister and hustles her connections throughout the US to keep the attack-Russia juggernaut going as in the past under a continuous barrage of ethnic prejudices and fake news.

The pattern is clear but unspoken. The Enemy Russia is the auto-pilot of fake news to divert from US and client leadership failure on almost every level. Relations of mutual respect with Russia’s ambassador are ‘collusion’ and taboo.

The Reality Beneath the Questions not Asked

How does disclosure of Hillary’s Clinton’s apparatus theft of the Democratic nomination from Bernie Sanders get blamed on Russia? The question is not asked. The Washington mass media and visible Congress focus instead on accused “collusion with Russia” with very big stakes in the new inquisition show. Suspicions without substance run free in the mass media once the designated Enemy is smeared onto the target, even if elected president.

Who knows that the US joined the armed forces of Britain, colonial Canada and Japan to crush the 1917 Russian Revolution on behalf of the Czarist autocracy and Western capitalism? More deeply, who names the governing objective behind all the shows of force and accusation over a century since? To be managed successfully, attention must be diverted from the facts of US-led war crimes and public looting within and without US empire proclaimed as ‘world freedom’.

The new President and his Exxon Secretary of State seek business-like relations with Russia. Very big powers are coming into conflict over business and war within the US empire. Big oil in both leviathan countries are pitted against the US Enemy-and-smear establishment which has long run the show with big oil formerly leading it. Now transnational big oil in the US and Russia are leading out of the blind alley of war against each other which has so totally failed to bring benefits to either side in the long term, and has almost reversed civilization.

The dots again are not joined. The completely counter-productive war against Russia to keep the US money-war state going is deepened by Wall Street. The falling price of oil is driven beneath notice by Wall Street which has successfully short-future-traded oil down to establish its money-printing powers by debt as supreme over its rival substitute, while diverting everybody’s attention from the greatest fraud in history still going. Observe that Wall Street remains untouched even from its multi-trillion dollar heist from public and pension coffers from 2007 on.

Blame Russia is the normal chorus which Wall Street benefits from as the ultimate leader of the ruinously anti-productive money-war system. It pays off so well to the money party in more public dollars appropriated by its control and issue of money debt for everything that exists; the pervasive military-industrial complex which never gets reversed even in the peace after the planned destruction of the ‘Evil Empire’; and the corporate mass media in front turning the fake news system over continuously to promote, idealize and divert from the global empire’s war and occupation powers. The neo-con and neo-liberal war strategists alike are built into the dark state as managers uniquely dependent on Russia as the Enemy.

So it is in all their self-maximizing interests to sustain perpetual accusations of some enemy’s evil as the great cover-up story of US empire and it inherited war-crime system. Joined to despotic local oligarchies, this axis dismantles ever more societies for corporate, bank and military plunder and jackal payoffs everywhere (including the academy). There is no limit or borders to the established system invasion, and all is at the expense of public treasuries and of life support systems across domains.

President Trump does not break the fatal ruling cycle. He demands that vassal states should pay for their US military protection, a new global extortion supporting new NATO oligarchies against change which accompanies his stripping of environmental protections to pay for more war powers. Trump behind his populist bluster is a paradigm example of instituted US capitalist greed and aggression. Yet the fact that hate of the Enemy is smeared even onto him for not hating Russia too reveals the ultimate pretext of the US-NATO war machine. Behind the US-led perpetual arms build-up, border threats and bombings of mostly innocents across the globe while blaming the terrorists for the horrors now built into the global ‘growth’ system is fake news as continuous cover story. The war-criminal drone mass murders continue on unnoticed. The bank looting of public wealth is instituted more broadly. The universities, health systems and public infrastructures are privatized for profit with no life criteria of outcomes.

Trump is dispossessing the American common wealth for big US money in line with the Reagan public-looting machine before him. It drained public revenues into a black hole of US debt, blamed acid rain on trees, and portrayed orchestrated mass murderers of socialists in Afghanistan and Nicaragua as ‘freedom fighters’. What has changed in the corporate media’s fake-news today?

Trump in office is the opposite of the anti-establishment candidate he promised to be. He wars on the US Environmental Protection Agency (its only collective life protective organization). He fractions corporate taxes in a giveway to the rich beyond Reagan’s $500-billion tax cut. He privatizes the public’s falling infrastructure for speculators and developers’ long-term private tolls, profits and control for private profit at taxpayers’ expense.

Who in the corporate media or Congress questions any of it?

The Trudeau regime to the north imitates the new massive scheme of privatizing public infrastructure. But it disguises it in terms of public investment in public goods. The big banks and speculators on both sides of the border are the winners whatever the corporate media and state cover story. The common wealth is sold off under pervasive fake news masquerading as responsible and for the public good. But the drive-wheel policy mechanisms for ever more dismantling of the living earth and redistribution of more public wealth upwards to the rich march on beneath conscious comprehension.

Trump does not hide the privatization for profit of America’s public infrastructure and stripping of public health and environmental protection policies once he has rising stockholder support in office. The Trudeau Liberal party masqueraded as the social democrat NDP in promising whopping public investment to win the election, but when in office lets the giant privatization boondoggle trickle out in sunny avoidance of the facts.

The monumental schemes of robbing the commonwealth at every level are led by slanted and selective reports through every step across ever more domains. But a constant across US empire is Russia the Enemy to justify it all. In the deepening life support crises of this ruling axis, Russia’s projected ‘attacks’ still lead the show.

The Life-Blind Moral DNA of US Rule

With no common ground but belief in God’s blessing over all nations and the greatest killing machine in history to enforce it, US ideology may seem to be a psychopathic rationalization writ large.

Yet the US national morality tale governs perception so that the a-priori life-blindness is not recognised even by philosophers. The US continues to be ruled at home and abroad without life-value ground or compass. So as the US-led global market system multiplies its demands on organic, social and ecological life systems, it moves inexorably towards a few multibillionaires with more wealth than 99% of the population, steering planetary depredation to ruin as freedom and growth.

How else would a global cancer system behave? Yet almost none recognise that this system overrides life requirements at every level. The reformer Trump selects for even more wealth and power to the home rich. He attacks evolved environmental research and regulations with no better alternative. He seeks to repeal Obamacare with no public option considered. His nationalist and cost-cutting program is essentially life-blind.

The baseline of crisis goes all down to the moral DNA of the US project and its evolved economic, political and ideological system. The innermost value driver is long presupposed without question by even US moral philosophers and social scientists as the first principle of their models. Atomic self-maximization towards more private money-value without limit is the meta-program.

In consequence, the ‘global free market’ the US leads and imposes has no feedback loops to protect human or planetary life against hollowing them out for transient commodities, private profit and wastes on every level. The ruling system is structured only to ensure more money demand and commodities to those who have money to pay. Any accountability to universal life necessities is ruled out a-priori from the US Constitution, ruling market doctrine, and received theories.

As I have commented in articles prior to his presidency, “Trump is America come to meet itself”. But the US cover story has not yet been decoded in its master functions of legitimation and idealization. What makes the eco-genocidal system acceptable to human consciousness is an ultimate story line and moral syntax that transforms it into heroic liberty, individualism and moral supremacy.

This moral syntax has been imprinted into US empire since its original revolution against Britain to invade the America West to the Pacific Ocean to appropriate and destroy all the life and life support systems of the developed first peoples there as ‘freedom’, ‘development’ and ‘self-defense’. What is required for the grand narrative’s success is to hide the reality of continuous eco-genocide by continuous false representations as the virtue and truth others fail to understand.

This first principle the justifying morality tale entails the second – that an alien Enemy must always be blamed for the system’s destructive attacks on barriers and resistance to it. Conversion of all life and life support systems to limitless self-maximization of the US system and its richest citizens then proceeds under cover of fake news with wars of acquisition and control represented as courageous and beneficent for all.

For-profit private corporations are the ever more empowered legal vehicles of this transnational system which is set to select for systematic self-maximization of the rich by all market, state and war means that can be constructed to enable it, starting with the US Constitution (as explained above). This set-point is built into the legislative, judicial and executive branches so that today the system outcome is a constitutionally ordered money-party control of all three branches of government as well as the funding systems of social sciences and philosophy.

Fake news in the widest sense provides a continuous cover story to mask and justify the underlying program which is not seen – the money-war party’s limitless take from life within and without the US that depends on a designated Enemy as perennial pretext to strip the US and global commonwealth against effective opposition or change.

Stop Pretending the Rich Care About You

One of the terrible things about being a lone bastion of bomb-throwing, fire-starting, up-against-the-wall-fascist-killing type of Anarchism is you have to mingle and jive with the enemy. Like a Seminole off the reservation and walking into the Hard Rock Casino for the first time your nerves and mind are almost assaulted by the sheer idiocy of what we call modern living. I speak of course of the fake empathy held by rich “left” liberals and their kin.

Take for instance the Meryl Streep acceptance speech, widely being lauded as…well, nobody really seems to say what it is besides some rich lady getting up on stage and talking about somebody she doesn’t like. Everywhere I look online the words “heroic” are being used, how the speech was “everything.”

Why?

Because some Hollywood actress who supported a widely acknowledged War Criminal feels salty that her personal team of bourgeoisie didn’t win an election? Because she “bravely” stood up at a catered event in a dress that cost more than you or I make in a month to tell other rich people how “persecuted” they were?

I heard the speech, actually sat down and watched it. No where is she saying that the United States is some fascist superpower, that we’ve fucked up the world and Donald Trump is set to make it even worse; she’s merely upset it’s not bombing the ever-living shit out of Syria with silk gloves on.

These people are not your goddamn comrades, they are not far away intellectuals that only need to read “the bread book” to figure out where they’ve gone wrong. These are the same people who RALLIED around a woman that called Black children “super-predators” for godsake!

These creatures, these slimy denizens of far off nooks and crannies filled with champagne and $100,000 fundraisers are absolutely wedded to the same system that produced Donald Trump in the first place. They are not looking to rock the boat, they are not feeling sorry for foreign-born people and outsiders when they declare anything not on TV as “fake news” from spooky ole’ Russia and casually muse how many megatons it might take to wipe Moscow off the fucking map.

How about that speech to a bunch of bankers where Hillary makes clear her support for a no-fly zone over Syria would end up turning its people into hamburger meat?

“They’re getting more sophisticated thanks to Russian imports. To have a no-fly zone you have to take out all of the air defense, many of which are located in populated areas. So our missiles, even if they are standoff missiles so we’re not putting our pilots at risk—you’re going to kill a lot of Syrians.”

Where was the concern for foreign lives then?

Hollywood “care” for the most “at risk” is merely an act, a feigned empathy that is designed to make you forget that when push comes to shove they will make sure their money in tax-free offshore accounts stays safe rather than fund homeless shelters or soup kitchens.

They are as deceitful and treacherous as their cousins on the Right are stupid and violent. They are the Athenian merchants hailing their own empire while criticizing the growth of Sparta.

“Disrespect invites disrespect. Violence incites violence,” says Meryl, clutching her pearls amid other American aristocrats whose lives depend on the ongoing exploitation of millions. I looked twice to see if the fucking Romanovs or Marie Antoinette had possessed the woman but alas, she was spirit free. She is so out of touch she seems bewildered that anybody might disagree or even dislike the esteemed patricians she’s speaking to.

From where exactly does Meryl think the rage of the Red States comes from, their desire for change at any cost? Could it be the strip-mining of American manufacturing?

“The story changed dramatically in 2000. Since then, the U.S. has shed 5 million manufacturing jobs, a fact opponents of free trade mention often…

Since the 1960s, manufacturing has always paid substantially more than the minimum wage. Even today, the manufacturing jobs that remain average $20.17 an hour. That’s nearly three times the federal minimum wage.”

The fall in American standards of living?

“Today the average worker makes $8.50/hour — more than 57% less than in 1970. And since the average wage directly determines the standard of living of our society, we can see that the average standard of living in the U.S. has plummeted by over 57% over a span of 40 years.”

The obscene growth in CEO profits while Millennials earn less than their parents did?

“U.S. CEOs of major companies earned 20 times more than a typical worker in 1965; this ratio grew to 29.9-to-1 in 1978 and 58.7-to-1 by 1989, and then it surged in the 1990s to hit 376.1-to-1 by the end of the 1990s recovery in 2000. The fall in the stock market after 2000 reduced CEO stock-related pay (e.g., options) and caused CEO compensation to tumble until 2002 and 2003. CEO compensation recovered to a level of 345.3 times worker pay by 2007, almost back to its 2000 level. The financial crisis in 2008 and accompanying stock market decline reduced CEO compensation after 2007–2008, as discussed above, and the CEO-to-worker compensation ratio fell in tandem. By 2014, the stock market had recouped all of the value it lost following the financial crisis. Similarly, CEO compensation had grown from its 2009 low, and the CEO-to-worker compensation ratio in 2014 had recovered to 303.4-to-1, a rise of 107.6 since 2009.”

“Single young people are getting poorer compared to the average population even those with dependent children, with stagnating disposable income and onerous living costs pressing down on prosperity.

New data accessed by the Guardian reveals that singletons aged 25 to 29 in eight rich countries – the US, UK, Australia, Canada, Spain, Italy, France and Germany – have become poorer over the last 20 years compared with the average population, and unattached young adults are finding it harder than ever to set up on their own.”

All facts conveniently left out of Meryl’s hard-hitting critique. The Left abandoned the working class for 50 years in favor of upper-middle class kids in college who spent more time dying their hair than reading Marx or even Stirner. NAFTA, a hellish neo-liberal agreement that looted Mexico to fatten the profits of American corporations, was drawn up not by some scary Republican tyrant but the “cool” Democrat and blowjob-aficionado Bill Clinton.

“During NAFTA, Mexico has had the slowest rate of economic growth than [with] any other previous economic strategy since the 1930s. From 1994 to 2013, Mexico’s gross domestic product per capita has grown at a paltry rate of 0.89 percent per year.” Additionally, “During NAFTA, Mexico’s economy grew much slower than almost every Latin American country. So to say that NAFTA has benefited the Mexican economy is also a myth. It has boosted trade and investment, but this has not translated into meaningful growth that generates jobs. One of the problems that NAFTA has generated is basically an exporting economy for transnational corporations, not for the Mexican industry per se.”

It turns out that not only did NAFTA, “flood Mexico with imported corn and cheap grains from the United States,” but “it also destroyed Mexico’s own industries,” according to Perez-Rocha.”

Where THE FUCK was Hollywood for that? For Libya? For Fast and Furious? For literally any of the ongoing despicable behavior this godforsaken Imperium has exported to millions of innocent human beings across the globe for the last eight fucking years?

Meryl Streep, and the millions of well-to-do liberals like her, want to live in a world where every McDonald’s is turned into a Panera, where every Wal-Mart blossoms into a Target. Sure you still work there, and you have no organizing rights and your pay is shitty, BUT at least your owners give money to gay charities and recycle!

Hooray ethical consumption! Never mind the suicide nets around those factories, did you know for every shirt you buy we’ll give $5 to help feed silverback gorillas? I mean, we don’t know how it works, and we can’t really say HOW we feed them but…but you can feel good about the shirt!

These people are only allies in the sense that they discredit our other enemies. Anybody that wants to shit on Donald Trump has my blessing but to pretend that they actually desire anything close to an increase in economic quality is a farce.

They are merely rich people that don’t want to feel guilty about being rich.

Don’t worry Meryl, as the US economy continues to take a shit and standards of living race to the bottom, more and more of us will be more than happy to help you overcome your feelings of guilt.

Washington’s Global Economic Wars

Introduction
During most of the past two decades Washington has aggressively launched military and economic wars against at least nine countries, either directly or through its military aid to regional allies and proxies. US air and ground troops have bombed or invaded Afghanistan, Iraq, Pakistan, Libya, Somalia, Syria, Yemen and Lebanon.

More recently Washington has escalated its global economic war against major economic rivals as well as against weaker countries. The US no longer confines its aggressive impulses to peripheral economic countries in the Middle East, Latin America and Southern Asia: It has declared trade wars against world powers in Asia, Eastern and Central Europe and the Gulf states.

The targets of the US economic aggression include economic powerhouses like Russia, China, Germany, Iran and Saudi Arabia, as well as Syria, Yemen, Venezuela, Cuba and the Donbas region of Ukraine.

There is an increasingly thinner distinction between military and economic warfare, as the US has frequently moved from one to the other, particularly when economic aggression has not resulted in ‘regime change’ – as in the case of the sanctions campaign against Iraq leading up to the devastating invasion and destruction.

In this essay, we propose to examine the strategies and tactics underlying Washington’s economic warfare, their successes and failures, and the political and economic consequences to target nations and to world stability.

Washington’s Economic Warfare and Global Power
The US has used different tactical weapons as it pursues its economic campaigns against targeted adversaries and even against its long-time allies.

Two supposed allies, Germany and Saudi Arabia, have been attacked by the Obama Administration and US Congress via ‘legal’ manipulations aimed at their financial systems and overseas holdings. This level of aggression against sovereign powers is remarkable and reckless. In 2016 the US Justice Department slapped a $14 billion dollar penalty on Germany’s leading international bank, Deutsche Bank, throwing the German stock market into chaos, driving the bank’s shares down 40% and destabilizing Germany’s financial system. This unprecedented attack on an ally’s major bank was in direct retaliation for Germany’s support of the European Commission’s $13 billion tax levy against the US-tax evading Apple Corporation for its notorious financial shenanigans in Ireland. German political and business leaders immediately dismissed Washington’s legalistic rhetoric for what it was: the Obama Administration’s retaliation in order to protect America’s tax evading and money laundering multinationals.

The chairman of the German parliament’s economic committee stated that the gross US attempt to extort Deutsche Bank had all the elements of an economic war. He noted that Washington had a “long tradition of using every available opportunity to wage what amounted to a trade war if it benefits their own economy” and the “extortionate damages claim” against Deutsche Bank were a punitive example. US economic sanctions against some of Germany’s major trade partners, like Russia, China and Iran, constitute another tactic to undermine Germany’s huge export economy. Ironically, Germany is still considered “a valued ally” when it comes to the US wars against Syria, Afghanistan and Iraq, which have driven millions of refugees to Europe creating havoc with Germany’s political, economic and social system and threatening to overthrow the government of ‘ally’ Angela Merkel.

The US Congress launched an economic-judicial war against its closest ally in the Gulf region when it approved legislation granting US victims of Islamist terrorism, especially related to the attacks on September 11, 2001, the right to sue the government of Saudi Arabia and seize its overseas assets. This included the Kingdom’s immense ‘sovereign funds’ and constitutes an arbitrary and blatant violation of Saudi sovereignty. This opens the Pandora’s Box of economic warfare by allowing victims to sue any government for sponsoring terrorism, including the United States! Saudi leaders immediately reacted by threatening to withdraw billions of dollars of assets in US Treasuries and investments.

The US economic sanctions against Russia are designed to strengthen its stranglehold on the economies of Europe which rely on trade with Russia. These have especially weakened German and Polish trade relations with Russia, a major market for German industrial exports and Polish agriculture products. Originally, the US-imposed economic sanctions against Moscow were supposed to harm Russian consumers, provoke political unrest and lead to ‘regime change’. In reality, the unrest it provoked has been mainly among European exporters, whose contracts with Russia were shredded and billions of Euros were lost. Furthermore, the political and diplomatic climate between Europe and Russia has deteriorated while Washington has ‘pivoted’ toward a more militaristic approach.

Results in Asia have been even more questionable: Washington’s economic campaign against China has moved awkwardly in two directions: Prejudicial trade deals with Asian-Pacific countries and a growing US military encirclement of China’s maritime trade routes.

The Obama regime dispatched Treasury Secretary Jack Lew to promote the Trans- Pacific Partnership (TPP) among a dozen regional governments, which would blatantly exclude China, Asia’s largest economic power. In a slap to the outgoing Obama Administration, the US Congress rejected his showpiece economic weapon against China, the TPP.

Meanwhile, Obama ‘encouraged’ his erstwhile ‘allies’ in the Philippines and Vietnam to sue China for maritime violations over the disputed ‘Spratly Islands’ before the Permanent Court of Arbitration. Japan and Australia signed military pacts and base agreements with the Pentagon aimed at disrupting China’s trade routes. Obama’s so-called ‘Pivot to Asia’ is a transparent campaign to block China from its markets and trading partners in Southeast Asia and Pacific countries of Latin American. Washington’s flagrant economic warfare resulted in slapping harsh import tariffs on Chinese industrial exports, especially steel and tires. The US also sent a ‘beefed up’ air and sea armada for ‘joint exercises’ along China’s regional trade routes and its access to critical Persian Gulf oil, setting off a ‘war of tension’.

In response to Washington’s ham-fisted aggression, the Chinese government deftly rolled out the Asian Infrastructure Investment Bank (AIIB) with over fifty countries eagerly signing on for lucrative trade and investment deals with Beijing. The AIIB’s startling success does not bode well for Obama’s ‘Pivot to Pacific Hegemony’.

The so-called US-EU-Iran accord did not end Washington’s trade war against Teheran. Despite Iran’s agreement to dismantle its peaceful uranium enrichment and nuclear research programs, Washington has blocked investors and tried to undermine trade relations, while still holding billions of dollars of Iranian state assets, frozen since the overthrow of the Shah in 1979. Nevertheless, a German trade mission signed on a three billion trade agreement with Iran in early October 2016 and called on the US to fulfill its side of the agreement with Teheran – so far to no avail.

The US stands alone in sending its nuclear naval armada to the Persian Gulf and threatens commercial relations. Even the Kingdom of Saudi Arabia, the longstanding enemy of the Iranian Islamic Republic, has agreed to a cooperative oil production arrangement at a recent OPEC meeting.

Washington’s declaration of economic warfare against two of its most strategic powerful allies, Germany and Saudi Arabia and three rising competitor world powers, has eroded US economic competitiveness, undermined its access to lucrative markets and increased its reliance on aggressive military strategies over diplomacy.

What is striking and perplexing about Washington’s style of economic warfare is how costly this has been for the US economy and for US allies, with so little concrete benefit.

US oil companies have lost billions in joint exploitation deals with Russia because of Obama’s sanctions. US bankers, agro-exporters, high-tech companies are missing out on lucrative sales just to ‘punish’ Russia over the incredibly corrupt and bankrupt US coup regime in Ukraine.

US multi-national corporations, especially those involved in Pacific Coast transport and shipyards, Silicon Valley high tech industry and Washington State’s agro-export producers are threatened by the US trade agreements that exclude China.

Iran’s billion dollar market is looking for everything from commercial airplanes to mining machinery. Huge trade deals have has been lost to US companies because Obama continues to impose de facto sanctions. Meanwhile, European and Asian competitors are signing contracts.

Despite Washington’s dependence on German technical knowhow and Saudi petro-dollar investments as key to its global ambitions, Obama’s irrational policies continue to undermine US trade.

Washington has engaged in economic warfare against ‘lesser economic powers’ that nevertheless play significant political roles in their regions. The US retains the economic boycott of Cuba; it wages economic aggression against Venezuela and imposes economic sanctions against Syria, Yemen and the Donbas region in eastern Ukraine. While these countries are not costly in terms of economic loss to US business interests, they exercise significant political and ideological influence in their regions, which undermine US ambitions.

Conclusion
Washington’s resort to economic warfare complements its military fueled empire building.

But economic and military warfare are losing propositions. While the US may extract a few billion dollars from Deutsch Bank, it will have lost much more in long-term, large-scale relations with German industrialists, politicians and financiers. This is critical because Germany plays the key role in shaping economic policy in the European Union. The practice of US multi-national corporations seeking off-shore tax havens in the EU may come to a grinding halt when the European Commission finishes its current investigations. The Germans may not be too sympathetic to their American competitors.

Obama’s Trans-Pacific Partnership (TPP) has not only collapse, it has compelled China to open new avenues for trade and cooperation with Asian-Pacific nations – exactly the opposite of its original goal of isolating Beijing. China’s Asia Infrastructure and Investment Bank (AIIB) has attracted 4 time more participants than Washington’s TPP and massive infrastructure projects are being financed to further bind ASEAN countries to China. China’s economic growth at 6.7% more than three times that of the US at 2%. Worse, for the Obama Administration, Washington has alienated its historically most reliable allies, as China, deepens economic ties and cooperation agreements with Thailand, Philippines, Pakistan, Cambodia and Laos.

Iran, despite US sanctions, is gaining markets and trade with Germany, Russia, China and the EU.

The Saudi-US conflict has yet to play-out but any escalation of law suits against the kingdom will result in the flight of hundreds of billions of investment dollars from the US.

In effect, Obama’s campaign of economic warfare may lead to the infinitely more costly military warfare and the massive loss of jobs and profits for the US economy. Washington is increasingly isolated. The only allies supporting its campaign of economic sanctions are second and third rate powers, like Poland and current corrupt parasites in Ukraine. As long as the Poles and Ukrainians can ‘mooch’ off of the IMF and grab EU and US ‘loans’, they will cheerlead Obama’s charge against Russia. Israel, as long as it can gobble up an additional $38 billion dollars in ‘aid’ from Washington, remains the biggest advocate for war against Iran.

Washington spends billions of US tax-payer dollars on its military bases in Japan, Philippines and Australia to maintain its hegemony in the Asia-Pacific region. Its allies, though, are salivating at the prospect for greater trade and infrastructure investment deals with China.

Economic warfare doesn’t work for the Washington because the US economy cannot compete, especially when it attacks its own allies and traditional partners. Its regional allies are keen to join the ‘forbidden’ markets and share in major investment projects funded by China. Asian leaders increasingly view Washington, with its ‘pivot to militarism’ as politically unreliable, unstable and dangerous. After the Philippine government economic mission to China, expect more to ‘jump ship’.

Economic warfare against declared adversaries can only succeed if the US is committed to free trade with its allies, ends punitive sanctions and stops pushing for exclusive trade treaties that undermine its allies’ economies. Furthermore, Washington should stop catering to the whims of special domestic interests. Absent these changes, its losing campaign of economic warfare can only turn into military warfare – a prospect devastating to the US economy and to world peace.

Freedom Rider: Dump the Democrats for Good

“The Democrats were so entrenched in their corruption and self-dealing that they didn’t see the Bernie Sanders campaign for modest reform as the savior it might have been.”

This columnist did not see a Donald Trump victory coming. The degree of disgust directed at an awful candidate was more than I had predicted. Neither the corporate media, nor Wall Street nor the pundits nor the pollsters saw this coming either. Their defeat and proof of their uselessness is total. Those of us who rejected the elite consensus and didn’t support Hillary Clinton should be proud.

Black people are now in fear and in shock when we ought to be spoiling for a fight. All is not lost. Even the victory of the openly bigoted Trump poses an opportunity to right our political ship. Not the electoral ship, the political one. For decades black Americans have been voting for people who have done them wrong. Bill Clinton got rid of public assistance as a right, and undid regulations that kept Wall Street in check. He put black people in jail and yet black people didn’t turn on him until he and his wife tried to defeat Obama. But Obama gave us more of the same. Bailouts of Wall Street, interventions and death for people all over the world, and a beat down of black people who still loved him. Despite the fear of Republican victory we end up losing whenever a Democratic presidential candidate wins.

Victory is ours if we dump the Democrat Party and their black misleaders. The Democrats were so entrenched in their corruption and self-dealing that they didn’t see the Bernie Sanders campaign for modest reform as the savior it might have been. Instead they marched in lock step with a woman who was heartily disliked. Sanders went along as the sheep dog who led his flock straight over the cliff. The Democrats inadvertently galvanized people who had stopped participating in the system and who want change from top to bottom.

One of our biggest problems lies not in facts but in perceptions. What did Democrats do for black people? The Democrats ship living wage jobs off shore in corrupt trade deals like NAFTA and TTP. They don’t prosecute killer cops or raise the minimum wage. Trump will be hard pressed to deport more people than Obama did. The list of treachery is very long.

When Donald Trump asked black people, “What have you got to lose?” his words were met with derision. But in reality he posed a good question. What do we have to show for years of Democratic votes? Obama bailed out banks, insurance companies, Big Pharma and even Ukraine. But he didn’t rebuild Detroit or New Orleans. The water in Flint, Michigan is still poisoned and the prisons are still full.

“There may be opportunity in this crisis if we dare to seize it.”

The outpouring of love for Barack Obama was purely symbolic. In state after state, black people who gave him victory in 2008 and 2012 stayed home. They loved seeing him and his wife dressed up at state dinners but they were never fully engaged in politics because that is not what Democrats want. The love was phony and void of any political intent. Donald Trump will be president because of that veneer of political activism.

As for white people who voted for Trump, of course many of them are racists. However they are not without valid complaints. They don’t want neoliberalism but black people don’t either. They don’t want wars around the world and neither do black people. We corrupt our own heritage of radicalism in favor of shallow symbolism. While we slept walk in foolish nostalgia for Obama and cried at the thought of him leaving office, white people kept their hatred of Hillary to themselves or lied to pollsters. They want America to be great again, great for them. White nostalgic yearnings are dangerous for black people, and we must be vigilant. But there may be opportunity in this crisis if we dare to seize it.

Republicans have been the white people’s party for nearly 50 years. Trump just made it more obvious. He didn’t tell us anything we didn’t already know. We don’t have to be the losers in this election. Let us remember what we have achieved in our history. Half of black Americans didn’t even have the right to vote in the 1960s yet made earth shattering progress in a short time. But we must understand the source of that progress. It came from struggle and daring to create the crises that always bring about change.

Yes white people will strut for president Trump but that doesn’t mean we must submit as if we are in the Jim Crow days of old. We have ourselves to rely on and we can reclaim our history of fighting for self-determination. The dread of redneck celebration should not be our primary motivation right now. Before we quake in fear at white America we must send the scoundrels packing.

The black politicians and the Democratic National Committee and the civil rights organizations that don’t help the masses must all be kicked to the proverbial curb. The rejection must be complete and blame must be laid squarely at their feet.

Those of us who voted for the green party ticket of Jill Stein and Ajamu Baraka must stand firmly and proudly for our choice. We must strategize on building a progressive party to replace the Democrats who never help us. We must applaud Julian Assange and Wikileaks for exposing their corruption. There should be no back tracking on the fight to build left wing political power.

The black people who didn’t return to the polls shouldn’t be blamed either. Those individuals must have personal introspection that is meaningful and political. Their lack of enthusiasm speaks to Democratic Party and black misleadership incompetence. We should refrain from personal blame and help one another in this process as we fight for justice and peace.

The end of the duopoly is the first step in liberation. Staying with a party that literally did nothing was a slow and agonizing death. Sometimes shock therapy is needed to improve one’s condition. If we don’t take the necessary steps to free ourselves this election outcome will be a disaster. Instead, why not bring the disaster to the people who made it happen? The destruction of the Democratic Party and creation of a truly progressive political movement is the only hope for black America.

The Secret Global Court – Why Corporate Criminals and Corrupt Politicians Desperately Want the TPP

Obama needs to ensure he gets well compensated after leaving office for a job well done protecting, defending and further enriching the global oligarch class. This is precisely why he’s so adamant about passing the TPP during the upcoming lame duck session of Congress, when he knows “representatives” who no longer face reelection can be coerced or bribed into voting for this monumental public betrayal.

The Trans-Pacific Partnership (TPP) ins’t really a free trade deal, it’s a way for global oligarchs to consolidate, grow and protect their enormous wealth. The investor-state dispute settlement system (ISDS) is perhaps the most nefarious and objectionable aspect of the deal, with this shadowy court system being used to accomplish the following for the super rich and powerful:

1) Eliminate sovereign risk from their investments.

2) Earn money by scouring the world for potential ISDS “opportunities” and then speculating on them.

3) Escape prosecution from criminality on a global basis.

The whole thing is absolutely disgusting and epitomizes all that is wrong and unethical about the world today. As such, stopping the TPP from passage is probably the most important near-term challenge ahead for all of us who want to make the world a better place (or at least prevent it from getting much, much worse).

Before getting into today’s article, I want to commend Chris Hamby and BuzzFeed for publishing this extremely timely and important work. We can only hope that it will inform millions of Americans sufficiently to create the needed pushback to prevent the TPP from ever becoming law.

So without further ado, let’s get on with it. What follows are excerpts from Part 1 of a four part investigative series. My snippets don’t do this work the justice it deserves; as such, I strongly encourage you to read the entire piece and share it with everyone you know.

Now, from the blockbuster piece, The Court That Rules the World:

Imagine a private, global super court that empowers corporations to bend countries to their will.

Say a nation tries to prosecute a corrupt CEO or ban dangerous pollution. Imagine that a company could turn to this super court and sue the whole country for daring to interfere with its profits, demanding hundreds of millions or even billions of dollars as retribution.

Imagine that this court is so powerful that nations often must heed its rulings as if they came from their own supreme courts, with no meaningful way to appeal. That it operates unconstrained by precedent or any significant public oversight, often keeping its proceedings and sometimes even its decisions secret. That the people who decide its cases are largely elite Western corporate attorneys who have a vested interest in expanding the court’s authority because they profit from it directly, arguing cases one day and then sitting in judgment another. That some of them half-jokingly refer to themselves as “The Club” or “The Mafia.”

And imagine that the penalties this court has imposed have been so crushing — and its decisions so unpredictable — that some nations dare not risk a trial, responding to the mere threat of a lawsuit by offering vast concessions, such as rolling back their own laws or even wiping away the punishments of convicted criminals.

This system is already in place, operating behind closed doors in office buildings and conference rooms in cities around the world. Known as investor-state dispute settlement, or ISDS, it is written into a vast network of treaties that govern international trade and investment, including NAFTA and the Trans-Pacific Partnership, which Congress must soon decide whether to ratify.

The BuzzFeed News investigation explores four different aspects of ISDS. In coming days, it will show how the mere threat of an ISDS case can intimidate a nation into gutting its own laws, how some financial firms have transformed what was intended to be a system of justice into an engine of profit, and how America is surprisingly vulnerable to suits from foreign companies.

The series starts today with perhaps the least known and most jarring revelation: Companies and executives accused or even convicted of crimes have escaped punishment by turning to this special forum. Based on exclusive reporting from the Middle East, Central America, and Asia, BuzzFeed News has found the following:

A Dubai real estate mogul and former business partner of Donald Trump was sentenced to prison for collaborating on a deal that would swindle the Egyptian people out of millions of dollars — but then he turned to ISDS and got his prison sentence wiped away.

In El Salvador, a court found that a factory had poisoned a village — including dozens of children — with lead, failing for years to take government-ordered steps to prevent the toxic metal from seeping out. But the factory owners’ lawyers used ISDS to help the company dodge a criminal conviction and the responsibility for cleaning up the area and providing needed medical care.

Two financiers convicted of embezzling more than $300 million from an Indonesian bank used an ISDS finding to fend off Interpol, shield their assets, and effectively nullify their punishment.

When the US Congress votes on whether to give final approval to the sprawling Trans-Pacific Partnership, which President Barack Obama staunchly supports, it will be deciding on a massive expansion of ISDS. Donald Trump and Hillary Clinton oppose the overall treaty, but they have focused mainly on what they say would be the loss of American jobs. Clinton’s running mate, Tim Kaine, has voiced concern about ISDS in particular, and Sen. Elizabeth Warren has lambasted it. Last year, members of both houses of Congress tried to keep it out of the Pacific trade deal. They failed.

ISDS is basically binding arbitration on a global scale, designed to settle disputes between countries and foreign companies that do business within their borders. Different treaties can mandate slightly different rules, but the system is broadly the same. When companies sue, their cases are usually heard in front of a tribunal of three arbitrators, often private attorneys. The business appoints one arbitrator and the country another, then both sides usually decide on the third together.

“It works,” said Charles Brower, a longtime ISDS arbitrator. “Like any system of law, there will be disappointments; you’re dealing with human systems. But this system fundamentally produces as good justice as the federal courts of the United States.”

I mean, it takes some nerve to make a statement like that.

But over the last two decades, ISDS has morphed from a rarely used last resort, designed for egregious cases of state theft or blatant discrimination, into a powerful tool that corporations brandish ever more frequently, often against broad public policies that they claim crimp profits.

Because the system is so secretive, it is not possible to know the total number of ISDS cases, but lawyers in the field say it is skyrocketing. Indeed, of the almost 700 publicly known cases across the last half century, more than a tenth were filed just last year.

Driving this expansion are the lawyers themselves. They have devised new and creative ways to deploy ISDS, and in the process bill millions to both the businesses and the governments they represent. At posh locales around the globe, members of The Club meet to swap strategies and drum up potential clients, some of which are household names, such as ExxonMobil or Eli Lilly, but many more of which are much lower profile. In specialty publications, the lawyers suggest novel ways to use ISDS as leverage against governments. It’s a sort of sophisticated, international version of the plaintiff’s attorney TV ad or billboard: Has your business been harmed by an increase in mining royalties in Mali? Our experienced team of lawyers may be able to help.

In a little-noticed 2014 dissent, US Chief Justice John Roberts warned that ISDS arbitration panels hold the alarming power to review a nation’s laws and “effectively annul the authoritative acts of its legislature, executive, and judiciary.” ISDS arbitrators, he continued, “can meet literally anywhere in the world” and “sit in judgment” on a nation’s “sovereign acts.”

Some entrepreneurial lawyers scout for ways to make money from ISDS. Selvyn Seidel, an attorney who represented clients in ISDS suits, now runs a specialty firm, one that finds investors willing to fund promising suits for a cut of the eventual award. Some lawyers, he said, monitor governments around the world in search of proposed laws and regulations that might spark objections from foreign companies. “You know it’s coming down the road,” he said, “so, in that year before it’s actually changed, you can line up the right claimants and the right law firms to bring a number of cases.”

Can you believe this? Outside of technology, pretty much all the big money being made these days is from purely parasitic, extractive activities.

Opposition to ISDS is spreading across the political spectrum, with groups on the left and right attacking the system. Around the world, a growing number of countries are pushing for reforms or pulling out entirely. But most of the alarm has been focused on the potential use of ISDS by corporations to roll back public-interest laws, such as those banning the use of hazardous chemicals or raising the minimum wage. The system’s usefulness as a shield for the criminal and the corrupt has remained virtually unknown.

This is why Obama will try to pass it when the fewest members of government can be held accountable.

Most of the 35-plus cases are still ongoing. But in at least eight of the cases, bringing an ISDS claim got results for the accused wrongdoers, including a multimillion-dollar award, a dropped criminal investigation, and dropped criminal charges. In another, the tribunal has directed the government to halt a criminal case while the arbitration is pending.

One lawyer who regularly represents governments said he’s seen evidence of corporate criminality that he “couldn’t believe.” Speaking on the condition that he not be named because he’s currently handling ISDS cases, he said, “You have a lot of scuzzy sort-of thieves for whom this is a way to hit the jackpot.

Now here’s an example of ISDS abuse from Egypt.

But, though Mubarak was gone, he had left behind a gift for investors like Sajwani: one of the world’s largest networks of investment treaties — twice the size of the United States’ — that allowed foreign businesses to file ISDS claims against Egypt. Within a week of Sajwani’s conviction over the Red Sea deal, Damac invoked one of these treaties and sued Egypt before the international arbitration arm of the World Bank.

This argument — that the government at the time gave its blessing, so the sweetheart deal couldn’t be criminal — became the template for other businesses facing similar accusations.

By filing an ISDS claim, Sajwani took his case out of the Egyptian court system and placed it in the hands of three private lawyers convening in Paris. For the arbitrator he was entitled to choose, Sajwani appointed a prominent American lawyer who had often represented businesses in ISDS cases. And to press his case, Sajwani hired some of the world’s best ISDS attorneys.

For Egypt, the potential losses were big and would come as the country struggled to revive its floundering economy.

It decided to settle.

But the key benefit for Sajwani, according to all three: In exchange for dropping his ISDS case, Egypt would wipe away his five-year prison sentence and close out the probes of the other deals. The man who had been convicted of collaborating on a deal that would bilk the Egyptian people out of millions of dollars was now free and clear.

“Damac, followed by multiple other cases filed, made them say, ‘You know what, no; there should be another way,’” said Girgis Abd el-Shahid, a lawyer who represents corporate clients and assisted with Sajwani’s arbitration claim. “I believe that, after Damac, Egypt learned its lesson.”

Virtually across the board, the government began trying to settle.

In one case, an Egyptian court had declared a foreign company’s purchase of a factory corrupt and nullified the deal, court records show. But after the company filed an ISDS claim, the government agreed to pay $54 million in a settlement — roughly twice the price the company had paid for the factory just a few years earlier, according to news reports and documents reviewed by BuzzFeed News. A lawyer for the company said that his client had not been found guilty of a crime and that the company had made “significant investments” in the factory after acquiring it.

In another case, a second Dubai developer was under investigation — until he threatened an ISDS claim, according to the Cairo lawyer Hani Sarie-Eldin, who has represented the company. Instead of a criminal trial, the government opted for a settlement, and the mogul’s company went forward with its project, Sarie-Eldin said.

Meanwhile, the government has changed its laws, stripping public-interest lawyers and average citizens of the right to file court challenges to dubious public contracts, such as the sale of public land to a developer like Sajwani.

Heba Khalil, a researcher at an Egyptian human rights organization, recently recalled the chaotic but hopeful days after the fall of Mubarak. “No one knew what Egypt would be like,” she said. “International investors were kind of scared that the kind of deals that they did with the Mubarak regime wouldn’t be possible anymore.”

Then came the ISDS claims. “I think the impact of international arbitration,” Khalil said, was that Egyptians “started knowing that, ‘Oops, if we try to expose corruption, then those investors will take us to court internationally, and we will lose the case. Which means we had better just shut up and let the wrongs of Mubarak continue the way they are.’”

Here’s an example from El Salvador.

Not long after the battery factory set up shop on the edge of Sitio del Niño in 1998, people began noticing clouds of ash floating over from their new neighbor, descending on fields where children played soccer and seeping into their homes at night. It burned people’s throats and sent them into coughing fits.

Eventually, people started connecting the ash with the persistent headaches, dizziness, extreme fatigue, and constant bone and joint pain that children in particular were suffering. In 2004, a committee of local citizens began petitioning leaders for help, writing the town’s mayor, national government ministries, and eventually even other nations’ embassies and international aid organizations. For years, their efforts came to naught.

Then lead started showing up at potentially dangerous levels in the blood of the town’s children. Testing in 2006 and 2007 found that dozens of children, some as young as 3, had been contaminated.

In the midst of the trial, the prosecution agreed to settle. Prosecutors declined to comment on the role ISDS played, but the settlement document lays out the terms. The company agreed to pay for a limited cleanup of only the factory site, far short of the much more expansive cleanup the government has said is needed, and to establish a medical clinic in the village, albeit one that would provide only basic care and be funded for only three years. The company would also pay for some of the costs associated with the prosecution and make small donations to the community. And it agreed to drop its threat and not pursue an ISDS case.

Ultimately, the court concluded that the factory had contaminated the village. But that same court acquitted the three lower-level managers, so, it reasoned, it had no choice but to exonerate the company, too.

A force that helped persuade the judges, said Girón, the company’s lawyer, was the ISDS threat and its potential to slam the government with huge compensatory damages.

The failure to hold the factory accountable is an open wound for the impoverished residents of Sitio del Niño — a village whose very name, “Place of the Child,” is now a cruel joke. For six years, their community has been designated an “environmental emergency” by the government, which has warned them not to eat anything grown in the town’s contaminated soil. But many of them have no other option.

When NAFTA, the North American Free Trade Agreement, took effect in 1994, some lawyers at top firms took notice of ISDS for the first time. One heralded “a new territory” where some pioneering attorneys had ventured and “prepared maps showing a vast continent beyond.” What they saw was the opportunity to expand and reshape ISDS to their benefit, and the previously dormant system changed forever.

“A whole industry grew up,” said Muthucumaraswamy Sornarajah, an international lawyer and ISDS arbitrator who argued that the system is now being misused. Large law firms, he said, see ISDS “as a lucrative area of practice, so what happens is they think up new ways of bringing cases before the arbitration tribunals.”

A key service offered by the ISDS legal industry goes by various euphemisms: “corporate structuring,” “re-domiciling,” “nationality planning.” Critics have a different term: “treaty shopping.” It amounts to helping businesses figure out which countries’ treaties afford the most leeway for bringing ISDS claims, then setting up a holding company there — sometimes little more than some space in an office building — from which to launch attacks.

ISDS lawyers also grow the market for their services by advocating for new treaties, and some of the most outspoken are beneficiaries of the revolving door between the US government and top law firms.

Now meet a particularly nefarious cretin, Daniel Price.

Daniel M. Price negotiated the section of NAFTA containing ISDS when he was a lawyer at the Office of the US Trade Representative. He later served as a top international trade official in the George W. Bush White House.

In between these government stints, he worked as a private lawyer helping clients in ISDS cases. Twice he used the treaty he himself had helped negotiate to help US-based businesses pursue claims against Mexico.

He founded and chaired the unit handling ISDS claims at Sidley Austin, a leading global law firm. Today, he promotes his services as an arbitrator and, along with a powerhouse team that includes other former government lawyers, sells international expertise on ISDS and related matters.

Price, who at first agreed to an interview but later stopped responding to messages, is only one of a number of private lawyers who have exerted outsize influence on American policy on ISDS.

Yes, America. This is your government.

Finally, companies can gain advantages by bringing an ISDS suit, even if they don’t expect to win the case. Krzysztof Pelc, an associate professor at McGill University, found that there has been a proliferation of frivolous cases primarily intended not to win compensation but rather to bully the government — and other nations that want to avoid a similar suit — into dropping public-interest regulations. These new cases, Pelc found, represent a fundamental transformation of ISDS: The system was designed to deal primarily with theft by autocrats, but, in the majority of cases today, businesses are suing democracies for enacting regulations.

Finally, here’s the third example of how ISDS allows powerful people convicted of crimes to escape justice.

The British financial guru Rafat Ali Rizvi had a big problem: In Indonesia, where he’d plied his trade, he and a business partner had been convicted of embezzling more than $300 million from one of the country’s banks. The government there had to bail out the bank — sparking enraged protests that police tried to quell with tear gas and water cannons — and Indonesian authorities were pursuing him and the money they said he’d stashed in accounts around the world.

Ensconced overseas, Rizvi was beyond the reach of the Indonesian authorities. But the conviction came with an Interpol “red notice,” meaning he risked extradition if he traveled abroad. Some of his bank accounts were frozen. And with this stain on his record, he was largely cut off from the world of global finance he’d played in for years.

Rizvi’s topflight criminal lawyer had threatened to sue Interpol if the agency didn’t delete the alert, but so far it hadn’t worked. What Rizvi needed was an entirely different type of lawyer. Someone like George Burn.

Burn had spent years representing businesses in corporate disputes, but, like many of his colleagues, he was drawn to ISDS as the system began to flourish in the 1990s. Now, he said, ISDS cases make up the majority of his work as a London-based partner at the U.S. firm Vinson & Elkins.

The strategy he crafted for Rizvi epitomizes the ingenuity of elite ISDS lawyers and the willingness of arbitrators — many of whom are also attorneys who argue ISDS cases — to expand their own authority. It is a stark example of how canny and audacious lawyers can work the system, crafting a win even when they technically lose. The only real losers: a nation of taxpayers.

As usual.

First, Burn needed to find a treaty that would apply to this case. His team discovered an obscure agreement among predominantly Islamic nations, including Indonesia, where the case was unfolding, and Saudi Arabia, where al-Warraq was a citizen. There was no record of anyone using that pact to file an ISDS claim before, but Burn audaciously forged ahead.

In fact, an official present at the creation of that treaty 30 years earlier told the tribunal that the agreement was not supposed to allow ISDS cases at all. The arbitrators waved off this objection as “irrelevant.”

The key argument that Burn planned to make was that the criminal trial in Jakarta had violated al-Warraq’s right to fair treatment as a foreign investor. This protection is now commonplace in investment treaties and trade deals, and it has become one of the most controversial aspects of ISDS.

Guaranteeing foreign businesses “fair and equitable treatment” sounds like common sense. But many treaties don’t say what exactly that means, so arbitrators have found that governments have acted unfairly even when they regulated the price of water or merely complied with European Union law. Critics argue that such judgments have transformed a system that was supposed to uphold the rule of law into one that places foreign businesses above the law, able to get out of obeying almost any statute or regulation, no matter how worthwhile, that cuts into profits.

Many scholars and activists say the “fair and equitable treatment” provision, which is included in the Trans-Pacific Partnership now being considered by Congress, is the most widely abused element of treaties containing ISDS. Numbers from the UN’s trade and development body show that arbitrators find violations of this controversial provision far more than any other.

As it happened, though, the treaty Burn had invoked didn’t include that clause. But the agreement did have another common and often controversial clause, which requires a government to treat foreign businesses covered under one treaty at least as well as businesses covered under any of its other treaties.

So Burn plucked the fair-treatment provision from another agreement and applied it to the Islamic nations pact. In effect, he constructed his own super-treaty.

And the ISDS arbitrators allowed it, giving themselves the authority to rule on the actual merits of the case.

Martha took that crucial finding and presented it to his former employer. He argued that, unless Interpol dropped its red alerts against Rizvi and al-Warraq, the international cops themselves would be violating international law. Interpol obliged, deleting the red notices.

“Unprecedented Concessions by Interpol,” trumpeted a press release put out on behalf of Martha’s firm. The international cops also had agreed to delete information about the two convicts from its files and to send letters to certain risk profiling and due diligence agencies, as well as the roughly 190 Interpol member countries, according to the release.

“As a result, Mr. Rizvi and Mr. Al-Warraq will be able to travel and conduct business without restriction,” the release boasted. “Such results have never been obtained before from INTERPOL.” Reached by BuzzFeed News, Martha at first agreed to an interview but didn’t respond to subsequent messages.

So gross.

Now the legal team is trying to use the ISDS decision to block Indonesia from seizing the men’s foreign bank accounts. Initially, Indonesian authorities had won a small victory when a Hong Kong court granted them access to a $4 million account. But that’s been put in doubt…
