Despite the lack of evidence linking Orlando mass murderer Omar Mateen to Daesh (ISIS) in any operational (direct) sense, the first inclination of U.S. Presidential hopeful Hillary Clinton was to renew American bombing of Syria, Iraq and Libya— the very nations that were destroyed by U.S. bombs directed by Mrs. Clinton and from whence Daesh arose. In so doing Mrs. Clinton made it evident that she is an unrepentant militarist whose bloodlust, combined with her longstanding interest in promoting American business interests, ties her to the U.S. imperial project of the last century and one-half. The precise moral difference between mass murders for personal and state reasons depends on a theory of the state at odds with this imperial project.

The company that employed Omar Mateen, G4S, is a British-based ‘security’ company that operates in 120 countries and as a ‘private’ supplier of public services to the Department of Homeland Security, the U.S. Army and to the very same State Department that Mrs. Clinton led as Secretary of State. The company advertises itself capable of ‘mitigating liability’ for the U.S. government— the ruse used by the CIA and other clandestine and quasi-clandestine government agencies to circumvent civil prohibitions on their activities by employing ‘private’ companies to carry them out. The NSA’s domestic surveillance programs tie to those of the FBI, DEA and CIA through this legalistic dodge. And ‘private contractors’ were behind some of the more grotesque slaughters in recent American wars.

The classical liberal separation of economic from political interests used to legitimate state violence is one that the Clintons have spent their ‘public’ careers undermining. As leading proponents of neoliberalism, the Clintons have spent three decades conflating ‘private’ interests with the public interest. In history this tie of U.S. business interests to U.S. military incursions runs from residual European imperialism, including genocide against the indigenous population and slavery, to direct wars, proxy wars, coups, assassinations, murders and particularly odious ‘wars of attrition.’ What is corruption in the liberal worldview is the nature of the capitalist-state acting in / on imperial interests in a Marxian frame. If this corruption is ‘solvable,’ such has yet to be demonstrated in the U.S.

Hillary Clinton’s use of the horrific crime in Orlando to instigate further crimes against untold innocents abroad is hidden behind manufactured fears of a lunatic and craven enemy (ISIS) that is in fact both a product of earlier U.S. atrocities across the Middle East and but a pale ghost of the savagery of combined U.S. actions in the region. The American leadership’s practice of creating crises that it must then ‘respond’ to led the way to the sequential slaughters, disruptions and dislocations that now finds substantial portions of the Middle East in ruins and millions of refugees flooding an increasingly xenophobic Europe. That this leadership never seems to learn from its ‘mistakes’ suggests motivations at work other than those presented at press conferences.

Where G4S, Omar Mateen’s employer, fits in is that Mr. Mateen was in many respects the perfect mercenary— ‘our psychopath’ if we were paying for his services. Murdering 49 people and wounding 50 more is, in addition to being an atrocity, a crime and a moral calamity, a complicated logistical feat. In 2004 U.S. Colonel James Steele was brought to Iraq, in a war that Bill Clinton publicly supported and Hillary Clinton voted for, to engineer like atrocities. Mr. Mateen’s crimes would have been business-as-usual in U.S. led slaughters of innocent civilians in Nicaragua and El Salvador in the 1980s and in Iraq in the 2000s. And G4S is precisely the type of ‘public-private partnership’ favored by the Clintons to ‘mitigate liability’ behind a veil of ‘private’ actions.

This isn’t to suggest that Hillary Clinton had any part in the murders carried out by Mr. Mateen. It is to suggest that in any human and / or moral sense she is congenitally unfit for public office. The most generous explanation of her support for George W. Bush’s criminal slaughter in Iraq is that she was misled by the manufactured evidence proffered by the Bush administration. That the war tied through history to the Clinton’s own sanctions against Iraq that resulted in half a million innocents dying from privation and to eight years of bombing that left much of the country in ruins suggests that Mrs. Clinton probably well understood that Iraq posed no threat to the U.S. in 2001. That the war was coincidentally a boon to Western business interests was / is as grotesque as it was predictable.

If conceptual clarity around these issues seems wanting here— that is the point. Neoliberalism as some unified theory of political economy ties through history to the Washington Consensus that in turn ties to American imperial history. Western imperialism— state-corporatism as division of the global economic spoils through insertion / assertion of ‘national’ interests, has five centuries of reasonably well defined history behind it. In this regard Donald Trump’s relative rhetorical reticence to use military force as a first choice is a threat to this imperial order whereas Hillary Clinton’s willingness to destroy an entire region of the world on a whim to benefit Exxon Mobil and Goldman Sachs makes her the ‘safe’ choice from the institutional perspective.

Washington Consensus precepts are:

*Fiscal discipline

*A redirection of public expenditure priorities toward fields offering both high economic returns and the potential to improve income distribution, such as primary health care, primary education, and infrastructure

*Tax reform (to lower marginal rates and broaden the tax base)

*Interest rate liberalization

*A competitive exchange rate

*Trade liberalization

*Liberalization of inflows of foreign direct investment

*Privatization

*Deregulation (to abolish barriers to entry and exit)

*Secure property rights

Against this imperial history the U.S. view that national elections are an internal matter places U.S. voters as the nominal ‘choosers’ of political economy for much of the world. In political terms, the 800+ military bases that the U.S. keeps around the globe serve as quasi-private security forces to assure repatriation of ‘profits’ for multi-national corporations in the form of resources, plentiful, cheap labor and the broader economy of imperial conquest. In fact, as opposed to theory, these profits are the reciprocal of the death, misery, subjugation and immiseration inevitably put forward by Western economists and politicians as the result of ‘free-choice’ by those on the losing end of American imperial fortune. That increasing numbers of Americans are on this losing end helps explain current (and heretofore slight) political unrest and its reciprocal in establishment support for Mrs. Clinton.

Hillary Clinton’s toxic jargon that “America never stopped being great” poses a seeming conundrum for her supporters who aren’t dedicated sociopaths. If U.S. wars in Southeast Asia, Central America, the Middle East and Northern Africa are evidence of this greatness, then what are the moral and political bases of such a judgment? Mrs. Clinton’s nostalgia for the days of alleged national unity following the attacks of September 11, 2001 is apparently for the erasure of the history that led to the attacks and not for unity per se. Conversely, given the absence of any operational link to Daesh, Omar Mateen could just as well have claimed that his crimes were motivated by Napoleon Bonaparte or Jesus Christ were ISIS not such a well-implanted foe.

Externally, and in contradiction of to the exceptionalists, the democratists and Western neoliberals, the U.S. is broadly considered the greatest threat to world peace on the planet. Brought to the fore in the current Presidential election cycle is that Western elites— inherited wealth, bailout-dependent bankers, the corporate lootocracy dependent on wildly goosed (by the Federal Reserve) asset prices and various and sundry agents, functionaries and court pleaders, are now well-understood to have interests diametrically opposed to those of the vast majority of Americans. The conceptual leap not yet taken by the American electorate is the international nature of this class divide.

This international ‘footprint’ is fact regardless of whether or not Americans consider it when voting. Internal economic dislocations, such as jobs lost and stagnant wages from trade agreements, find their reciprocals in indigenous economies destroyed, in ‘developing market’ industries shut out through subsidized ‘competition,’ in IMF ‘workouts’ that place ownership of developing industries in Western hands and through commodification and expropriation of millennia of accumulated knowledge to be put back as alien product against the peoples and cultures that developed it. In this respect, the ‘Clinton model’ of sweatshop labor as economic development joins the ‘Obama model’ of subverting civil law in the interests of corporate-state plutocrats.

Calls to unify behind Hillary Clinton in her bid to become President pose the heavily engineered outcome of the Democratic primaries as the popular will. In this sense they are roughly analogous to the calls to unite behind George W. Bush following the Bush v. Gore Supreme Court decision in 2000. The Clintons paved the way for Mr. Bush’s brutal militarism much as Barack Obama maintained the institutional infrastructure of the ‘unitary Presidency’ and the capacity for launching criminal wars of opportunity. Between Hillary Clinton and Donald Trump, it is Mrs. Clinton who has the proven record as guardian of empire and imperial prerogative. Her unbridled militarism is an expression of this prerogative.

The question for Democrats is how evil can someone be to still be worthy of voting for? Alleged stark differences between Hillary Clinton and George W. Bush find very high degrees of synchronicity between their actual policies (and those of Barack Obama). And lest this be unclear, it is the Democratic establishment that chose Mrs. Clinton as its candidate (chart above), and not the politically and economically dispossessed electorate. The grift that American elections reflect the popular will, and therefore confer political legitimacy, contrasts with the facts that the dominant Parties are largely and increasingly unpopular and that the popular will bears no relation to the policies decided upon and enacted by the American political establishment.

Hillary’s email revelation: France and US killed Qaddafi for his gold and oil

With the recent release of Hillary Clinton’s emails by Wikileaks, the public now knows exactly how the North Atlantic Treaty Organization (NATO) went from a collective defense organization to the new Barbary Coast Pirates of imperialism.

During the 2011 Libyan uprising, the United Nations Security Council passed Resolution 1973 which called for a ceasefire and authorized military action to protect civilian lives. A coalition formed, centered around NATO with the March 17, 2011 passing of the Resolution. Its purpose — a so-called “no-fly zone” over Libya.

The irony that the U.S.-dominated NATO military organization would be concerned with “protecting” Arab civilians is all too obvious since the United States is the nation most responsible for killing Arab civilians.

The real reasons for the attack have been dealt with most directly by America’s famous reformed “economic hitman,” John Perkins.

Perkins points out that the attack on Libya, like the attack on Iraq, has to do with power and control of resources, not only oil, but gold. Libya has the highest standard of living in Africa. “According to the IMF, Libya’s Central Bank is 100% state owned. The IMF estimates that the bank has nearly 144 tons of gold in its vaults,” Perkins wrote.

NATO went there like modern Barbary Coast Pirates — to loot Libya’s gold. The Russian media, in addition to Perkins, reported that the Pan-Africanist Qaddafi, the former President of the African Union, had been advocating that Africa use the gold so plentiful in Libya and South Africa to create an African currency based on a gold dinar.

“It is significant that in the months running up to the UN resolution that allowed the U.S. and its allies to send troops into Libya, Muammar al-Qaddafi was openly advocating the creation of a new currency that would rival the dollar and the euro. In fact, he called upon African and Muslim nations to join an alliance that would make this new currency, the gold dinar, their primary form of money and foreign exchange. They would sell oil and other resources to the US and the rest of the world only for gold dinars,” Perkins explained.

Revelation in Email to Hillary Clinton

Wikileaks released an unclassified U.S. Department of State document emailed to Hillary dated April 2, 2011, key Clinton aide Sidney Blumenthal confirmed that the Perkins was right and the attack on Libya had nothing to do with Qaddafi being a threat to the United States and NATO and everything to do with looting his gold.

“Qaddafi’s government holds 143 tons of gold, and a similar amount in silver. During late March, 2011, these stocks were moved to Sabha (south west in the direction of the Libyan border with Niger and Chad); taken from the vaults of the Libyan Central Bank in Tripoli,” Blumenthal reported to Clinton.

Blumenthal pointed out the purpose of Qaddafi’s precious metal: “This gold was accumulated prior to the current rebellion and was intended to be used to establish a pan-African currency based on the Libyan golden Dinar. This plan was designed to provide the Francophone African Countries with an alternative to the French franc (CFA).”

Blumenthal spells out the reason for NATO’s attack and France’s imperial plunder, “French intelligence officers discovered this plan shortly after the current rebellion began, and this was one of the factors that influenced President Nicholas Sarkozy’s decision to commit France to the attack on Libya.”

There were five reasons for France’s illegal war with NATO against Libya. Sarkozy sought, according to Blumenthal, “a. A desire to gain a greater share of Libyan oil production, b. Increase French influence in North Africa, c. Improve his internal situation in France, d. Provide the French military with an opportunity to assert its position in the world, e. Address the concern of his advisors over Qaddafi’s long term plans to supplant France as the dominant power in Francophone Africa.”

Under the neo-colonialism favored after World War II during the period of the Cold War, we preferred to bribe various African leaders to help us loot their nation’s resources. The U.S., of course, killed any Pan-African aspirations as well as potential leaders like Patrice Lumumba.

This highjacking of Arab and African resources and slaughtering of Arab civilians is a long-standing plan put forth by neo-conservatives in the United States. The Project for a New American Century (PNAC) has had a “hit list” of Arab nations and little regard for Arab casualties.

General Wesley Clark wrote in “Winning Modern Wars” that “As I went back through the Pentagon in November 2001, one of the senior military staff officers had time for a chat. Yes, we are still on track for going against Iraq, he said. But there was more. This was being discussed as part of a five-year campaign plan, he said, and there was a total of seven countries beginning with Iraq, then Syria, Lebanon, Libya, Iran, Somalia, and Sudan.

What we witnessed in Libya was old-fashioned 19th century imperialism — the deliberate plundering of a sovereign nation-state’s resources by more powerful Western conquistadors.

Meet the Indigenous Eco-feminists of the Amazon

In Ecuador, indigenous Kichwa women are resisting corporate interests that threaten their land.

For episode two of A Woman’s Place, Kassidy Brown and Allison Rapson traveled to Ecuador and ventured deep into the Amazon rainforest. There, issues of indigenous rights and the rights of women intersect in many ways. Corporate exploitation of indigenous land directly affects women who rely on natural resources for important aspects of their culture and daily lives.

This is one reason why Brown and Rapson sought out Nina Gualinga, a member of the Ecuadorian Kichwa tribe, internationally known for her indigenous rights activism. “In every episode we tried to address a different angle of feminism and a different way that it could be expressed,” Rapson said. For Brown and Rapson, Gualinga represented the power of eco-feminism, which combines environmentalism with feminist theory.

“We were struck by lots of things, but really it was just understanding her relationship to Mother Earth,” Rapson explained. “It’s a very personal relationship, and fighting for the planet, for them, is like fighting for a really powerful woman who needs their protection.”

The episode explains how, after oil companies began exploiting their land for fossil fuels, the Kichwa people protested, sued the government, and convinced the Inter-American Court of Human Rights to force oil companies out of Kichwa territory. But even though Kichwa women stood up to Big Oil and won, they still have to be vigilant. For Gualinga, and other Ecuadorian women interviewed for this episode, the capitalist system that threatens their land is also a key element of the modern patriarchy.

“It’s the kind of capitalism where big oil is coming in with a very masculine approach,” said Brown. “With the worst form of masculinity—aggressive, not listening to the community leaders, and not hearing what the people want.”

“All people have both feminine and masculine attributes. It’s not that all men are bad and it’s not that all masculine expression is bad,” Rapson said. “It’s that we are living with the remnants of an outdated and antiquated system.”

Gualinga says another obstacle indigenous women face is the stereotype that their communities are “primitive.” So when she brought Brown and Rapson to her village of Sarayaku, Gualinga showed them how Kichwa people have mixed modern technology with ancient traditions. The village uses solar panels for electricity—and Rapson explained that they even have their own “tech center”—while things like traditional teas and beauty products are still made by hand.

“It’s incredible to walk around the forest with Nina. She would pull this flower and tell us about how this oil would clear up your skin,” said Brown. “Then she would pull another thing that I would never recognize out of the rest of the foliage and say ‘This is great for your hair, it will make it longer and stronger.’ They have what they need there.”

This is part of the reason protecting their land is so important to the Kichwa.“It’s kind of like someone coming into your town and saying ‘I’m going to destroy your grocery store and your bank and your beauty salon,’” explained Rapson. “‘I’m going to literally take every aspect of your life—everything involved in how you live every day-to-day moment—and I’m going to get rid of all of that.’” Because when Gualinga and her fellow tribe members talk about protecting their environment, it’s more than just land. It’s protecting their history, their traditions, and their culture.

We Need a Social Economy, Not a Hyper-Financialized Plantation Economy

The key to broadly distributing capital and reversing inequality is to nurture the source of social capital: the community economy.

We all know what a hyper-financialized economy looks like–we live in one:central banks create credit/money out of thin air and distribute it to the already-wealthy, who use the nearly free money to buy back corporate shares, enriching themselves while creating zero jobs. Or they use the central-bank money to outbid mere savers to scoop up income-producing assets: farmland, rental properties, cartels, etc.

The only possible output of a hyper-financialized economy is rapidly increasing wealth and income inequality–precisely what we see now.

What we need is a social economy, an economy that recognizes purposes and values beyond maximizing private gains by any means necessary, which is the sole goal of hyper-financialized economies.

Given the dominance of profit-maximizing markets and the state, we naturally assume these are the economy. But there is a third sector, the community economy, which is comprised of everything that isn’t directly controlled by profit-maximizing companies or the state.

What differentiates the community economy from the profit-maximizing market and the state?

1. The community economy allows for priorities and goals other than maximizing profit. Making a profit is necessary to sustain the enterprise, but it is not the sole goal of the enterprise.

2. The community economy is not funded by the state.

3. The community economy is locally owned and operated; it is not controlled by distant corporate hierarchies. The money circulating in the community stays in the community.

4. The community economy is not dominated by moral hazard; the community must live with the consequences of the actions of its residents, organizations and enterprises.

The community economy includes small-scale enterprises, local farmer’s markets, community organizations, social enterprises and faith-based institutions. Its structure is decentralized and self-organizing; it is not a formal hierarchy, though leaders naturally emerge within civic and business groups.

Few Americans have worked on a plantation. I am likely one of the few who has lived and worked in a classic plantation town (Lanai City, circa 1970; I picked pineapples along with my high school classmates as a summer job).

In my analysis, the current financial system is akin to a Plantation Economy:highly centralized and hierarchical, devoted to maximizing profits for distant owners, a finance-fueled machine for extracting wealth from local economies.

We can differentiate the community economy by comparing it to a hyper-financialized Plantation Economy. In a Plantation Economy, a once-diverse landscape of decentralized, locally owned small enterprises is displaced by corporations that are dependent on the state for their profits via direct subsidies, tax breaks, or a cartel/monopoly enforced by the state. (Think Big Pharma, Big Defense, the Higher Education Cartel, etc.)

The corporate Plantation’s low wages leave many of its workers’ families dependent on state aid to survive, and so it prospers on the backs of taxpayers who subsidize its low wages and the externalization of costs.

The current system rewards those with access to cheap capital and the power of the state. The community economy has neither.

The Plantation Economy institutionalizes poverty, parasitic finance, externalized costs, moral hazard (since the corporate/state overseers do not live in the community being cannibalized) and centralized wealth and political power.These are the only possible outputs of the hyper-financialized Plantation Economy.

Once the Plantation Economy has displaced the community economy, opportunities for work and starting small enterprises shrivel, and residents become dependent on state social welfare for their survival. By eliminating the need to be a productive member of the community, the welfare state destroys positive social roles and the inter-connected layers of the community economy between the state and the individual.

When the individual receives social welfare from the state, that individual has no compelling need to contribute to the community or participate in any way other than as a consumer of corporate goods and services. State social welfare guts the community economy by removing financial incentives to participate or contribute.

Why is the community economy so important? The community economy is first and foremost the engine of social capital, which is the source of opportunity and widely distributed wealth.

Social capital is the sum of all the connections and relationships that enable productive collaboration, commerce, exchange and cooperation. (I cover all eight kinds of capital in my book.)

Corporations offer a limited version of social capital–for example, meeting a manager in another department at a company picnic–but most of this capital vanishes once an individual leaves the company (or is “right-sized” into unemployment). This social capital is only superficially embedded in a place and community, as corporations routinely move operations in pursuit of their core purpose: expanding profits.

Corporations cannot replace communities for the simple reason each organization has different purposes and goals. The sole purpose and goal of a corporation is to expand capital and profits, for if it fails to do so, it falters and expires.

The purpose of a community is to preserve and protect a specific locale by nurturing social solidarity: the sense of sharing a purpose with others, of belonging to a community that is capable of concerted, collective action on the behalf of its members and its locale.

Political scientist Robert Putnam has described this structure as a web of horizontal social networks. Unlike corporations and the state, community economies are horizontal networks, i.e. networks of peers connected by overlapping memberships and interests.

It is not accidental that the current system of hierarchical corporations, banks and the state increases inequality and erodes the community economy: the only possible output of low social capital is rising inequality.

Putnam identified a correlation between the inequalities enforced by oppressive elites (slavery being the most extreme example) fearful of the potential of egalitarian (horizontal) networks to organize resistance to their exploitation.

Areas with low social capital are characterized by limited social mobility and rising economic inequality. In other words, the only way to lessen economic inequality is to nurture the horizontal peer-to-peer community economy that creates social capital.

This makes sense, as communities stripped of social capital offer limited access to the other forms of capital needed to launch local enterprises and construct ladders of social mobility.

A vibrant community economy provides members with an infrastructure of opportunity, i.e. multiple pathways to building capital, gaining knowledge and connecting with others.

The key to broadly distributing capital and reversing inequality is to nurture the source of social capital: the community economy.

Accelerating technology can and should provide:

  • more personal freedom from labor,
  • more beauty in infrastructure and nature,
  • greater joy in our freedom to create and explore our beautiful, powerful, and diverse virtues (something like “resource-based economics” as researched by The Venus Project).

We know what we have is in contrived Orwellian opposition of what leadership should create. We know that what we receive is literal criminal fraud:

The first challenge for the 99.99% is to trust their own Emperor’s New Clothes observations that Earth is truly in this tragic-comedy rather than listen to the .01%’s lies attempting to cover naked facts anyone can see.

Please understand that I represent likely hundreds of thousands of professionals making factual claims with objective evidence anyone with a high school-level of education can verify. The purpose of education since the “Age of Enlightenment” is to present facts for public verification, and to seize the victory of refuting lies by would-be dictators, especially when such lies are obvious and of crucial public importance.

The path forward as we build a critical mass of humans recognizing the Emperor’s New Clothes truth is to demand arrests and solutions, obviously:

  1. ARRESTS: the first responsible action upon recognizing massive crimes that annually kill millions, harm billions, and loot trillions is to demand that law enforcement and military enact arrests of criminal leaders to stop the crimes and begin unwinding the truth of what happened in Earth’s tragic-comedy (four-part article series with videos on arrests as the obvious citizen response).
  2. SOLUTIONS: the .01% with corporate media have suppressed solutions documented beginning with Benjamin Franklin how government can abundantly operate without taxes: monetary and credit reform allow the public to have near-instant prosperity: full-employment, zero public deficits and debt, the best infrastructure we can imagine, falling prices, and release of public TRILLIONS held in “rainy day” accounts. Humanity’s choices:

  1. Ongoing .01% Orwellian, upside-down, tragic-comic, Emperor’s New Clothes crimes with all the pain, fear, harm, death, debt, poverty, enslavement, crime, destruction, and despair.

Ferguson and the Logic of Neoliberalism

While the U.S. Department of Justice report on racist policing practices in Ferguson, Missouri provides direct evidence for skeptical Whites that institutional racism is fact, limiting the investigation to Ferguson implausibly delimits the scope of race based repression in the U.S. Additionally, from slavery to convict leasing to funding the Ferguson city budget with fines and penalties overwhelmingly extracted from poor and middle class Blacks, the economic basis of police repression is isolated in an improbable present. And in fact, the ‘tricks and traps’ used by the Ferguson police for economic extraction closely resembles corporate practices of using contract law, state institutions and monopoly power to take economic resources from those who lack the social power to resist.

A cognitive challenge for White Americans (and ‘conservative’ Blacks) is the distance between facts like police repression in Ferguson and the mythology of capitalist democracy that we live by. Use of the police for economic extraction in Ferguson, for funding the town budget through racial repression, ties state power to economic power within the particular circumstances of American racial and economic history. In a most basic sense this integration reframes state-market relations claimed to relate capitalism to democracy. More broadly, the TPP and TIPP ‘trade’ deals being pushed by President Obama are a variation on the racist shakedown in Ferguson. Their intent is to replace state power with corporate power while leaving Western states intact to provide state services for the benefit of corporations and the illusion of democratic control.

Discovery of a police ‘black site’ in Chicago, the prevalence of racist violence by the police across the U.S., the return of debtor’s prisons and ‘civil forfeiture’ laws that allow the police to take belongings without evidence of a crime illustrate the growing lawlessness of the police. When tied to illegal surveillance carried out by the NSA, DEA and FBI against citizens and non-citizens alike and the extra-judicial powers claimed by Mr. Obama a picture of widespread state lawlessness emerges. When considered in the context of no criminal prosecutions for war crimes against the (George W) Bush administration or against prominent bankers in the financial and economic debacle of the last decade a picture of widespread elite lawlessness emerges. Clearly the state, including local police departments, exists for purposes other than enforcing fealty to the law.

Based on supporting economic theories it is superficially ironic that the resurgence of neo-liberalism since the 1970s is coincident with this growing integration of state and ‘private’ power. Premised on clearly delineated state and market roles, neo-liberalism was / is in theory the economic realm unhindered by state restrictions. This state-market delineation facilitates the facade that capitalism is related to democracy— political freedom in the realm of the political and economic freedom in the realm of the economic. As fact and metaphor the role of the Ferguson police using asymmetrical social power to take economic wealth from vulnerable citizens demonstrates the implausibility of this theorized differentiation in the realm of the political. And new debtor’s prisons (link above) have police and the prison system acting as collection agents for Payday Lenders.

The TPP and TTIP trade deals being pushed by Mr. Obama are designed with analogous levers for extorting wealth. The investor resolution clauses in TTIP have a supranational judiciary ruling on ‘investor’ lawsuits against governments for hypothetical lost profits and taxpayers on the hook for adverse rulings. The relative absence of remaining trade restrictions and tariffs is well covered territory. What remains to be accomplished with these ‘agreements’ is the consolidation of economic power as the power to extract wealth. As with proposals for tradable carbon credits, the ‘product’ of the agreements combines the right to extort by putting forward projects never intended to be built with guarantees against adverse economic developments.

The police in Ferguson used a particular social lever, the residual of slavery, for gratuitous racial repression and for economic extraction. Slavery is a social institution, but it most particularly is an economic institution. It is a social mechanism for accruing the product of slave labor to the slave master. And slavery in the U.S. was ‘legal’ until it wasn’t. Convict leasing was explicit use of ‘the law’ and the judicial system to force poor Blacks to work for little or no pay. ‘The law’ was used as an instrument of economic exploitation and extraction. The push back from Whites and conservative Blacks that the murdered Mike Brown was a criminal because he likely stole a box of cigars takes this same law at face value. This view of the law depends on a similarly improbable separation of political and economic realms as neo-liberal theory.

As political theory might have it, if all of the citizens of Ferguson were intended to benefit from city resources while poor and middle class Blacks were disproportionately forced to pay for them that represents economic taking by some citizens for the benefit of others. The racial character of this taking places it in history. The history of Western colonialism, neo-colonialism and imperialism places it in broader internal and external context. And this history is evidence that distinct realms of the economic and the political never described existing circumstance. The practical relevance is that it places the actions of the police in Ferguson, past and pending ‘trade’ agreements and global economic relations in the space where economic and political power act in an integrated social dimension.

The effect is to reframe ‘the law’ in terms of who is committing particular acts rather than the acts being committed. The police in Ferguson can murder with impunity and shake down citizens at their discretion to fund the city budget (and their paychecks) while poor and middle class Blacks are disproportionately murdered and sent to prison for similar acts. What is legal and what isn’t is determined by who has social power, not by the acts themselves. In a racist and classist society the law is codification of class and race interests. If a black citizen of Ferguson puts a gun to someone’s head and demands their valuables they are a criminal but if the same act is committed by a cop it is within the law. Here events in Ferguson are fact and metaphor— overwhelming evidence (links above) suggests that similar social relations exist across much of the country.

This view of the law has precedence in Richard Nixon’s contention that “when the President does it that means that it is not illegal.” Earlier precedence can be found in Nazi law and in the laws of fascist Italy in the 1930s and 1940s. This isn’t to call anyone who isn’t a self-proclaimed Nazi a Nazi. The precedence lies in the view that the law is the will of a leadership class, be it the Nazi leadership in Germany or city government in Ferguson. One problem with this theory is that it makes the law capricious and ultimately impossible to follow. Race based law enforcement criminalizes race, not nominally proscribed acts. Stories of the Chicago police department’s black site (link above) have political protesters and poor Blacks accused of no crimes taken there. If people can be arrested without evidence that a crime was committed then what is the difference in outcomes between committing and not committing crimes?

A relation of neo-liberalism to fascism can be made through replacement of civil governance with corporate governance that subordinates the rights and privileges of civil society to corporate interests. The investor-state dispute mechanisms (link above) being broadened and formally codified in the TTIP trade deal will be used to demand compensation for environmental regulations that keep drinking water safe and limit greenhouse gas emissions, the metaphorical equivalent of threatening to end the planet if we don’t pay up. Civil forfeiture has the police taking valuables they might want at the point of a gun if necessary. The Ferguson police shake down poor Blacks using the law as a weapon. At the same time a ruling elite has immunity from prosecution for well documented crimes.

Much of what is written here was well understood in the 1950s, 1960s and 1970s. It hardly seems an accident that this collective memory was lost to narrow ideological dogma. Across the country property taxes are being cut with partial differences made up through regressive fees and penalties. This fits the neo-liberal preference for property over labor incomes. And neo-liberal theory has no place for history because all acts within it take place in a temporally isolated present. This dissociates racist policing in Ferguson, Chicago, New York, Detroit and Philadelphia from the roles of the legislature, judiciary, police and prisons in reconstituting the economic exploitation of slavery under the guise of free choice in capitalist democracy. Race is the particular case in America; class is the broader expression of economic power.

The tension between the DOJ report (link above) on racist policing in Ferguson and the Obama administration’s broad support for neo-liberal policies will likely produce a tight circle drawn around events in Ferguson. Already supporters of police repression are raising the argument that the words “hands up, don’t shoot” never transpired. What bearing does precise wording have on a Black child being murdered by the police? And why wouldn’t Black youth have a right to be hostile to police who, as the DOJ reports concludes, are running a racist shakedown operation to force poor and middle class Blacks to fund city government? How would White readers react to being harassed, intimidated, disproportionately jailed and forced to pay for the privilege? Ultimately the problem is larger than Ferguson and social accountability should address political economy premised in exploitation and social repression.
